As used in this chapter, the following terms shall have the meanings
indicated:
PUBLIC OR COMMON NUISANCE
Shall be considered as that which is set up, maintained or continued
so as to interfere with or be injurious to the health of the community or
the public; or that which is an obstruction to the use of property.
WATER OF THE STATE
Includes all streams and springs, and all bodies of groundwater,
whether natural or artificial, within the boundaries of the state.
All bodies of water, whether natural or artificial, or containers or
receptacles containing water shall be maintained by their owners in such a
condition that mosquitoes cannot breed therein.
This section shall be covered under the provisions of 35 P.S. § 655.1
et. seq., regarding public eating and drinking places.
Any person, firm or corporation who shall violate any provision of this
chapter or who shall fail to post a bond shall, upon conviction before the
District Justice having jurisdiction thereof, be sentenced to pay a fine of
not more than $1,000, plus costs of prosecution, and, in default of payment
of such fine and costs, be subject to imprisonment of not more than 30 days.
