GENERAL REFERENCES

No person shall operate or permit a taxicab owned or controlled by him/her to be operated as a vehicle for hire upon the streets of the City of Lexington without having first obtained a certificate of public convenience and necessity ("certificate") from the Mayor.
An application for a certificate shall be filed with the Mayor upon forms provided by the City of Lexington. Said application shall be verified under oath and shall furnish the following information:
A. 
The name and business and residence addresses of the applicant.
B. 
The financial status of the applicant, including the amount of all unpaid judgments against the applicant and the nature of the transactions or acts giving rise to said judgments.
C. 
The number of vehicles to be operated or controlled by the applicant, and information concerning each vehicle, including make, model and year of vehicle, vehicle identification number and state license number.
D. 
Such further information as the Mayor may require.
No certificate of public convenience and necessity shall be issued or continued in operation unless there is in full force and effect a liability insurance policy or certificate showing the specific vehicles covered by an effective policy in the following minimum amounts: $100,000 for death or bodily injury to any one person; $300,000 for death and/or injuries to more than one person which are sustained in the same accident; and $50,000 for property damage resulting from any one accident.
If the Mayor finds that an applicant is fit, willing and able personally and financially to perform taxicab service and to conform to the provisions of this chapter, then the Mayor shall issue a certificate stating the name and address of the applicant, the number of vehicles authorized under said certificate, and the date of issuance; otherwise, the application shall be denied.
No certificate shall be issued or continue in operation unless the holder thereof has paid an annual license fee as set forth in Chapter 63, Fees, for the first taxicab and for each additional vehicle operated under the certificate. Said license fee shall be paid in advance and shall expire on December 31 of the year in which it is issued.

No certificate of public convenience and necessity may be sold, assigned or otherwise transferred without the consent of the Mayor. Before any transfer can become effective, the party seeking the certificate shall file with the Mayor an application containing all the information required in this chapter.
A certificate issued pursuant to this chapter may be revoked or suspended by the Mayor if the holder thereof has violated any provisions of this chapter or violated any ordinances of the City of Lexington or the laws of the United States or the State of Illinois, the violations of which reflect unfavorably on the fitness of the holder to offer public transportation. Prior to suspension or revocation, the holder shall be given reasonable notice of the proposed action to be taken and shall have an opportunity to be heard.
Any person, firm or corporation violating any provisions of this chapter shall be punishable by a fine in an amount not to exceed $750. A separate and distinct offense is deemed committed each day such violation continues.
