No person shall remove any dwelling house, barn, garage, outbuilding or other structure over or upon any public streets or avenues of the Village of Patchogue unless the Board of Trustees of said Village shall grant a written permit for such moving, signed by the Mayor and countersigned by the Village Clerk. No such permit shall be granted except upon a written petition of the owner of such structure, stating the intended route, the place from which and to which the building is to be moved and the size of the structure. The fee for the permit shall be as set from time to time by resolution of the Board of Trustees.[2]

No permit shall, however, be granted for the removal of any structure over or upon any of the public streets or avenues of the Village unless the owner of such building shall deposit with the Village Clerk cash in an amount specified by the Board of Trustees, or a surety company bond in a form which shall be approved by the Village Attorney and in an amount specified by the Village Board, conditioned for the removal of such building in such a manner as not to cause any injury to the person or property of another, including the property of the Village of Patchogue.
When the removal of such building shall be completed, any cash so deposited according to § 166-2 of this chapter shall be returned to such depositor upon his application, when it shall appear to the satisfaction of the Board of Trustees that there are no claims against the applicant for injuries incurred; in the event that it shall appear that the person or property of another or the property of the Village of Patchogue shall have been injured as a result of the removal, such deposit shall not be returned until said claim for damages shall have been determined and settled.
Any person who violates this chapter or fails to comply with any of its requirements shall, upon conviction thereof, be subject to the penalties provided in § 1-1 of the Code of the Village of Patchogue.
