No person shall use the public streets of the
Incorporated Village of Patchogue either above the said public street
or on or beneath the said public street for the purpose of maintaining
cables or wires through which electronic signals are intended to be
transmitted to public or privately owned television receivers, without
having first received from the Board of Trustees of the Incorporated
Village of Patchogue a franchise for the said use of the Village streets;
provided, however, that this section shall not apply to a person regulated
by the New York State Public Service Commission or by the Federal
Communications Commission.
No person shall operate commercially a community
antenna system business within the Village of Patchogue without first
having obtained a license therefor from the Village. Any person who

antenna system business within the Village whether or not he maintains
an office for doing business within the Village.
Every applicant for license must comply with the provisions of Chapter
255 of this Code.
It shall be in the sole discretion of the Board
of Trustees of the Village of Patchogue to grant any license. The
Board of Trustees shall not be required to consider anything more
than the general welfare of the citizens of the Village of Patchogue
in granting or refusing to grant such a license.
The license fee to be paid upon the granting
of a license shall be in an amount as set from time to time by resolution
of the Board of Trustees for each year or fraction thereof.
Each license issued shall be renewable annually
as of the first of January by the applicant reapplying and payment
of the license fee.
A license under this chapter may be suspended
or revoked for cause after a hearing by the Board of Trustees.
Any person who violates this chapter or fails to comply with any of its requirements shall, upon conviction thereof, be subject to the penalties provided in §
1-1 of the Code of the Village of Patchogue.
