It shall be unlawful for any person, firm, corporation or entity (hereinafter "person") to push, dump or deposit in any manner, or cause to be pushed, dumped or deposited in any manner, any snow or ice which has accumulated on any sidewalk or private property onto any private street, public street, public park or public property in Uwchlan Township.
The provisions of § 218-12 shall not apply to Uwchlan Township, its employees and contractors, involved in snow removal and deicing operations.
Any person violating the provisions of § 218-12, upon the direction of a Township police officer, the Township Manager, the Township Road Superintendent or their designees, shall immediately desist from pushing, dumping or depositing snow or ice onto the street or public property and shall remove any snow and ice from the street or public property that has been unlawfully deposited thereon. If the person so notified fails to comply as aforesaid, the Township shall assess a fine as provided in § 218-15 herein below.
Any person violating the terms of this article shall be guilty of a summary offense and, upon conviction thereof by a Magisterial District Judge, be sentenced to pay a fine of not more than $1,000 plus costs, including reasonable attorneys' fees. In default of payment thereof, the defendant may be sentenced to imprisonment for a term not exceeding 90 days. Each day that a violation continues shall be deemed a separate offense.
