Pursuant to 53 P.S. § 65599.1 of the Second Class Township Code,[1] the office of Township Manager of Jackson Township, York County, Pennsylvania, is hereby created.

The Township Manager shall be appointed for an indefinite term by a majority of all members of the Board of Supervisors. The Manager shall serve at the pleasure of the Board of Supervisors and he may be removed at any time by a majority vote of all its members. At least thirty days before such removal becomes effective, the Board shall furnish the Manager with a written statement setting forth its intention to remove him.
The Manager shall be chosen solely on the basis of executive and administrative abilities, with special reference to the duties of the office as herein outlined.
The Township Manager shall post bond at Township expense, with sufficient surety approved by the Board of Supervisors in the amount of $50,000, conditioned upon the faithful performance of his or her duties.
The salary of the Township Manager shall be fixed from time to time by resolution.
A. 
The Township Manager shall be the Chief Administrative Officer of the Township and shall be responsible to the Board as a whole for the proper and efficient administration of the affairs of the Township placed in his charge. The powers and duties of all Township business shall be vested in the Manager, unless expressly imposed or conferred by statute or ordinance upon other Township officers. The duties of the Township Manager shall not include any legislative powers. The powers and duties of the Manager shall include the following:
(1) 
To prepare and submit to the Board, before the close of each fiscal year, a budget for the next fiscal year and an explanatory budget message. In preparing the budget, the Manager or an officer designated by him shall obtain from the head of each department, agency or board or any qualified officer thereof estimates of revenues and expenditures and such other supporting data as required. The Manager shall review such estimates and may revise them before submitting the budget to the Board of Supervisors.
(2) 
To be responsible for the administration of the budget after its adoption by the Board.
(3) 
To develop, in conjunction with the preparation of the yearly budget, long-range fiscal plans for the municipality, such plans to be presented annually to the Board of Supervisors for its review and adoption.
(4) 
To hold such other office and to head such municipal departments as the Board may from time to time direct; provided, however, that such office shall not include the office of supervisor, auditor, assessor or Township police officer.
(5) 
To attend all meetings of the Board of Supervisors and its committees with the right to take part in the discussions. The Manager shall receive notice of all special meetings of the Board and its committees.
(6) 
To prepare the agendas for each meeting of the Board and supply facts pertinent thereto.
(7) 
To keep the Board informed as to the conduct of Township affairs; to submit periodic reports on the condition of the Township finances and such other reports as the Board requests; and to make such recommendations to the Board as he deems advisable.
(8) 
To submit to the Board, as soon as possible after the close of the fiscal year, a complete report on the finances and administrative activities of the Township for the preceding year.
(9) 
To see that the provisions of all franchises, leases, permits, agreements and privileges granted by the Township are observed.
(10) 
To employ, by and with the approval of the Board, experts and consultants to perform work and to advise in connection with any of the functions of the Township.
(11) 
To see that all money owed the Township is promptly paid and that proper proceedings are taken for the security and collection of all the Township's claims.
B. 
The duties of the Township Manager shall be delegated or changed as directed by the Board of Supervisors. These duties shall not include any legislative powers.

A. 
Jackson Township, York County, Pennsylvania, shall indemnify and hold harmless from any personal liability any Supervisor elected subsequent to the passage of this article arising out of his or her duties as Supervisor.
B. 
This indemnity shall cover only that portion of the judgment not covered by insurance from any source.
C. 
Jackson Township shall retain the right of subrogation for any amount paid under this article.
D. 
This indemnification shall cover judgments for breach of contract, negligence, intentional torts and punitive as well as compensatory damages.
E. 
The Township shall endeavor to have a defense provided through the insurance carriers for the Township. If no insurance carrier is available, the Township Solicitor shall provide a defense. If it is a conflict of interest for the Solicitor to defend, then the Township shall hire an attorney to defend the Supervisor. The Township's obligation for legal defense is limited to one attorney for all three Supervisors, and if the Supervisors desire different or multiple attorneys, it shall be at their personal expense.
F. 
Under no circumstance shall the Township indemnify a Supervisor for any act which, in the written opinion of the Solicitor or District Attorney, is an indictable criminal offense in the Commonwealth of Pennsylvania.
