A. 
No person, firm or corporation owning or occupying any real property within a residential zone of the Township shall permit any grass, weeds or any vegetation, not edible or planted for some useful or ornamental purpose, to grow or remain upon such premises so as to exceed six inches in height or, where weeds are concerned, to allow the same to go to seed. In all other zoning districts, the height shall be no more than 12 inches.
B. 
The following shall be excepted from the maximum heights stated herein:
(1) 
Areas within public road or street rights-of-way that are maintained by Jackson Township or the Commonwealth of Pennsylvania, Department of Transportation.
(2) 
Areas within or a part of stormwater facilities that are designed to operate with grass, weeds or vegetation in excess of the maximum height restrictions stated herein.
C. 
Any violation of this section is hereby declared to be detrimental to the health, safety and cleanliness of the inhabitants of the Township.
Persons responsible for meeting the requirements of this chapter shall be the occupiers of the premises and/or the owner thereof.

Notice to comply with this chapter may be given by certified United States Mail by the Permit Officer of the Board of Supervisors and shall grant 10 days for the compliance.

If the person responsible fails to comply, the Township may enter and perform the necessary work and the cost therefor shall be collected from the person responsible by a suit before a District Magistrate.

A. 
Any person, partnership, firm or corporation who or which has violated or permitted the violation of the provisions of this chapter shall, upon conviction thereof in a summary proceeding before a District Magistrate, be sentenced to pay a fine of not more than $1,000, plus costs, or, in default thereof, shall be imprisoned to the extent allowed by law for the punishment of summary offenses.
B. 
All judgments, costs and reasonable attorney fees collected for the violation of this chapter shall be paid over to the Township Treasurer.
