This chapter shall be known as the "Curfew Ordinance."
It shall be unlawful for any minor under the age of 18 to stay out, loiter or be present on any property within Jackson Township between the hours of 11:00 p.m. and 6:00 a.m. unless said minor shall be on property owned by a parent or guardian or be in the company of an adult guardian, with the following exceptions:
A. 
Where minors are legally employed and are present on any property in the cause of employment.
B. 
Where minors possess a senior driver’s license and are legally operating a vehicle in furtherance of their employment as provided in Subsection A above.
C. 
Where in the presence of approved adult chaperones, coaches or mentors where the minor is attending an activity sponsored by a school, religious, nonprofit, government, athletic or similar organization.
D. 
Where minors possess written permission, dated the same day and signed by a parent/guardian, specifying the starting/ending times, place(s), purpose and the necessity of the minor being out after the curfew.
No parent, guardian or other adult person having the care and custody of a minor under the age of 18 years shall permit such minor to be present on another’s property within Jackson Township between the hours of 11:00 p.m. and 6:00 a.m. unless said minor shall be accompanied by his or her parent, guardian or other adult person or where one of the exceptions set forth in § 56-2 applies.
A. 
Any person, partnership, firm or corporation who or which has violated or permitted the violation of the provisions of this chapter shall, upon conviction thereof in a summary proceeding before a District Magistrate, be sentenced to pay a fine of not more than $1,000, plus costs, or, in default thereof, shall be imprisoned to the extent allowed by law for the punishment of summary offences. In lieu of imposed fines for minor or parents/guardians, the District Magistrate may authorize alternative penalties, such as community service, counseling or educational classes.
B. 
All judgments, costs and reasonable attorneys' fees collected for the violation of this chapter shall be paid over to the Township.
