A. 
No person shall drink any alcoholic beverage as defined in MGL c. 138, § 1:
(1) 
While in or upon any public way or alley or any way to which the public has a right of access, whether in or upon a vehicle or motor vehicle or on foot; or
(2) 
While in or upon any place to which the public has access as invitees or licensees, including but not limited to parks, reservations, playgrounds and conservation land; or
(3) 
While in or upon any private land, building, structure or place without the consent of the owner or person in control thereof.
B. 
All alcoholic beverages in possession of a person or persons in violation of this bylaw shall be seized and safely held until final adjudication of the charge against the person or persons arrested or summoned before the court, at which time they shall be returned to the person or persons entitled to lawful possession.
C. 
Notwithstanding any general, zoning, or other bylaw, rule or regulation to the contrary, the provisions of this Chapter 179 shall not apply to the service or consumption of alcohol within any licensed premises, inclusive of outdoor seating areas, that are located within the University Avenue Mixed Use District, and subject to an approved Master Development Plan under Section 9.8 of the Westwood Zoning Bylaw.
