6, Ch. 2, Art. E, of the 1987 Code)]
Every telegraph, telephone and electric company
which now or in the future maintains or uses poles on any street or
alley in the Borough is required:
A. To submit to the official inspection of every pole.
B. To remove defective or dangerous poles from the public
highway immediately upon written notice so to do duty survey by the
inspector or any person appointed by Council so to do.
C. To pay or cause to be paid to the Borough the cost
thereof if the neglect or refusal of the corporation compels the Borough
to remove such poles.
D. To annually pay or cause to be paid to the Borough
Treasurer on or before the first Monday of March of each year a license
fee as shall be set by resolution of the Borough Council from time
to time for each pole occupying or being upon public highways
of the Borough.
The penalty for every violation of any of the
provisions and requirements of this article shall be a fine of $5
for each pole concerning which there is such violation to be recovered
for the use of the Borough, to be recovered as fines and penalties
are by law recoverable.
