This article shall be known as and cited as the "West Brandywine Township Oversize/Overweight Vehicle Ordinance."
On or after July 2, 2009, any person or carrier desiring to operate a vehicle which is oversize or overweight, as defined by the Commonwealth of Pennsylvania and in § 184-22 of this article, on the streets owned by West Brandywine Township shall file with the Township Police Department for a hauling permit and shall pay the required fee for permit as specified herein § 184-23, at least 24 hours in advance of the intended hauling. This article does not apply to state-designated routes that lie within the West Brandywine Township. Movement of oversized/overweight vehicles on state routes within West Brandywine Township shall be regulated by a permit issued by the Commonwealth of Pennsylvania.
Definitions of terms used in the Code of the Township of West Brandywine are as set forth in Chapter 1, General Provisions, Article III, Terminology.
The permit fees for oversized/overweight vehicles on Township roads shall be as follows:
A. 
Fifty dollars, general issuance for all oversized vehicles per single trip. A maximum of seven consecutive days of single-trip permits will be issued.
B. 
Fifty dollars, general issuance for all overweight vehicles, per single trip. A maximum of seven consecutive days of single-trip permits will be issued. An additional $0.50 per ton over allowable legal weight shall be assessed to permit fee.
C. 
Three hundred dollars for monthly (30 consecutive days), unlimited trips, for oversized load permit only. Approval by Township Police Department required. Approval to be based upon load type and transportation route selected.
D. 
One thousand dollars for yearly (365 consecutive days), unlimited trips, for oversized load permit only. Approval by Township Police Department required. Approval to be based upon load type and transportation route selected.
E. 
All future fee amendments to this article shall be adopted by resolution by the Board of Supervisors.
To move a vehicle the dimensions of which exceed the limitations specified in § 184-22, an application shall be made to the West Brandywine Township Police Department for an oversize/overweight vehicle on a hardcopy or online form supplied by the WBTPD.
A. 
The applicant for an oversized/overweight vehicle shall provide to West Brandywine Township proof of liability insurance with coverage limitation of not less than $1,000,000. Upon receipt of permit fee and proof of liability insurance, the Township of West Brandywine shall provide the applicant with an oversized and/or overweight permit to operate in West Brandywine Township.
B. 
The permit shall list the name of the applicant; identify the truck and/or trailer information, overall dimensions of the load, weight of the vehicle, number of axles and axle distances. The permit shall also list the route, origin and destination. The permit shall denote if an escort or pilot vehicle is required for the move.
C. 
An applicant shall elect a permit to be valid for a seven-day single-trip; monthly unlimited trips (oversized only); or yearly unlimited trips (oversized only).
D. 
A physical route survey is required prior to the issuance of a permit to ensure that the proposed routing can be negotiated safely.
E. 
West Brandywine Township shall be listed as an additional insured for property damage and personal injury, in the amount specified herein.
The applicant shall assume all liability for repairs and shall perform or have performed, to the satisfaction of the West Brandywine Township, repairs to roads or structures which have been damaged as a result of operation under this permit. To ensure no conflict of existing road conditions between the applicant and Township, the applicant reserves the right to videotape or photograph the travel route and provide the Township with a copy of said video.
The hours of operations for oversized/overweight vehicles in the Township are as follows:
A. 
Sunrise to sunset, seven days a week; however, inclement weather may postpone requested travel dates.
B. 
No movement on any official federal, state or local holiday.
A. 
All oversize/overweight vehicles traveling on West Brandywine Township streets shall display "oversize load" banners on the front and rear of the vehicle. The banners shall be at least seven feet wide by 18 inches high. The vehicle/load shall also display flags on projecting loads; the flags shall be not less than 18 inches square.
B. 
Oversized/overweight vehicles may not travel within 1,000 feet of another oversize/overweight vehicle.
A. 
An escort or pilot vehicle shall not exceed 10,000 pounds. The escort/pilot vehicle shall have a minimum of two flashing yellow lights and also display two "oversize load" banners on the front and rear of the vehicle. The signs shall be at least five feet wide and one foot high. The vehicle shall have two-way communication with the oversize/overweight vehicle. Vehicle personnel shall have the authority to direct traffic and ensure that traffic disruption is minimal. Escort personnel shall wear a yellow reflective vest when engaging in directing traffic. Escort vehicles are required to carry proof of liability insurance with a minimal coverage of $1,000,000 naming West Brandywine Township as additional insured; proof of coverage shall be filed with the Township.
B. 
One escort vehicle is required when the load or vehicle is in excess of 13 feet or when the total length exceeds 90 feet. The escort vehicle shall lead the oversize/overweight vehicle to warn or notify oncoming traffic of the forthcoming condition.
The oversize/overweight permit does not allow the vehicle or combination to exceed posted bridge limits.
Any oversize/overweight vehicle operating on Township streets without a valid oversize/overweight permit shall be subject to a fine of $1,000. Any permitted oversized/overweight vehicle which violates any section of this article shall be subject to pay a fine of $500.
