Every individual who is detained and/or arrested for any traffic
offense or violation of the Crimes Code of the Commonwealth of Pennsylvania
and who is detained at a facility operated by the municipality with
whom West Brandywine Township has contracted for detention and feeding
of such individual shall be liable and responsible and required to
pay for such detention services.
Detention service costs shall be provided to either the Magisterial
District Justice and/or the Chester County District Attorney's
Office with the request that said costs be added and/or assessed against
said individual.
In the event that costs are not assessed and/or not paid by
the said individual, such detention costs may be collected by civil
action by the Township against the said individual as a municipal
claim under the Act of May 6, 1923, P.L. 207, as amended (53 P.S.
§ 7101 et seq.). In either event, a penalty of 10% in interest
at the rate of 10% per annum shall be added and collected as provided
by law.
