Pursuant to the powers granted by the Second Class Township Code,[1] a Board is hereby created to be known as the "West Brandywine Township Parks and Recreation Board."

The said Board:
A. 
Shall consist of seven members who shall be residents of West Brandywine Township.
B. 
Shall be appointed by the Board of Supervisors.
C. 
Shall be appointed for a term of five years, with members to serve five-year staggered terms as of January 1 of each year.
D. 
A vacancy on the said Board shall be filled by the Board of Supervisors for the remainder of the unexpired term.
E. 
The Board shall have the right to make recommendations to the Board of Supervisors for proposed appointees to the Board to fulfill full or unexpired terms.
The members of the Parks and Recreation Board shall serve without compensation, although they may be reimbursed for expenses necessary to carry out the objectives of the Board when those expenses are deemed necessary and appropriate and approved by the Board of Supervisors in advance of such expenditures.
At the first meeting of each year, the said Board shall elect its own chairman and secretary and create and fill such offices as it deems proper and necessary. The Board may make and alter its rules of procedure consistent with the ordinances of the Township and the laws of the Commonwealth. It shall keep records of its minutes, transactions, findings and determinations, and such records shall be public except when prejudicial to a negotiation and therefore not in the public interest. A majority of the Board shall constitute a quorum, and action taken at a meeting shall require affirmative vote of the majority.
The Board shall serve in advisory capacity for the promotion of parks and recreation and to accomplish this purpose:
A. 
The Board shall monitor and review the recreational needs of the Township and shall advise the Board of Supervisors as to possible location, site and development of park lands within the Township.
B. 
The Board shall assist the Board of Supervisors in the planning of parks and recreation, including locating and coordinating financing for potential park sites and recreational programs.
C. 
To review all plans or proposals for subdivisions submitted to the Township pursuant to the Pennsylvania Municipalities Planning Code, as amended, Act 170 of 1988,[1] to ensure that said plans comply with all Township ordinances in regards to proposed parks and recreational needs of said proposed development.

D. 
The Board shall not employ any personnel or consultants without the express written approval of the Board of Supervisors.
E. 
The Board may make recommendations to the Board of Supervisors regarding selection, standards and qualifications of personnel or consultants employed or to be employed by the Township for the purpose of parks and recreation. Any recommendations of the Board shall be subject to the approval of the Board of Supervisors and acted upon by the Board of Supervisors as it sees fit.
F. 
The Board shall not own real or personal property or maintain a treasury or bank account without the express written approval of the Board of Supervisors.
G. 
The Board shall prepare and submit a yearly budget to the Board of Supervisors for sums deemed necessary to carry out the duties and objectives of the Parks and Recreation Board, on or before October 1 of the preceding year. Funds shall be allocated to the Board as the Board of Supervisors shall determine in its sole discretion.
H. 
The Board shall prepare a yearly report of all activity by January 1 of each year, for presentation to the Board of Supervisors.
I. 
The Board shall assist the Board of Supervisors in searching for financial assistance from all appropriate local, Township, County, State and Federal and other agencies for the implementation of parks throughout the Township.
The Board of Supervisors may appropriate from the general Township funds such funds as may be necessary and available for the work of the Parks and Recreation Board in the year for which the appropriation is made.
The Parks and Recreation Board shall serve only as an advisory Board to the Board of Supervisors and shall not possess the powers of the Board of Supervisors.
This chapter shall become effective on August 17, 1995, as provided by law.
