This chapter shall be applicable to all territory within the Town of Dickinson outside of incorporated villages.
All wells, cisterns, recharging basins, catch basins or sumps six inches or more in diameter shall have either a wood cover of a thickness of at least two inches or a metal cover of a thickness of at least 1/2 inch, which shall either be flush with the level of the ground or above ground level and securely fastened so that it shall stay in place, or shall be completely surrounded with protective fencing at least four feet in height and constructed of wire or material of a similar nature so that admission by persons to the well or cistern can only be gained by an opening in the fence left for said purpose. Said fence shall be secured to posts firmly embedded in the ground, which said posts shall not be in excess of eight feet apart. Any means of entry by openings left in the fence by a gate or otherwise must provide a manner for closing said opening, and said opening must at all times be kept securely closed and locked except when being used to gain admittance.

The owner of the premises where a violation of any provision of this chapter has been committed or shall exist or the lessee or tenant of the entire premises where such violation has occurred shall, upon conviction thereof, be subject to a fine not exceeding $250 or imprisonment for a term not exceeding 15 days, or both.
