It is the purpose of this chapter to regulate the speed, mooring and anchoring of boats in the waters of Greenwood Lake located within the territorial limits of Greenwood Lake.
This chapter shall be known as the "Boating and Recreation Law of the Village of Greenwood Lake."
It shall be a violation of this chapter for any person to:
A. 
Proceed by any vessel, through either the west arm or east arm of Greenwood Lake, north of the buoys marking the entrance of each arm, from the main lake at a speed which produces a wake and/or wave from the boat. For the purpose of this section, a "wave" shall consist of water rolling off the bow and bottom of the boat and which becomes the wake as it flows pass the stern of the boat.
B. 
Moor, anchor, tie down or stop any vessel within that area as marked by New York State buoys or within that area within the territorial limits of the Village of Greenwood Lake, specifically described as follows: Beginning at a point in the waters of Greenwood Lake, said point being N40° 33 20 W, 289.96 feet from a concrete monument located in the west arm of said lake off the foot of Windermer Avenue, and from said point of beginning, running the several courses and distances, as follows:
(1) 
N34° 59 46 W, 473.87 feet to a proposed marker or buoy; thence
(2) 
N59° 04 25 E 250.00 feet to an iron monument in the shoreline of the land fronting on said westerly arm of Greenwood Lake; thence
(3) 
Along said shoreline as the same winds and turns along said lake, to a fence post fixed on said shoreline at a point in a straight line drawn from a monument between property now of Barden and Brown, which said straight line runs S35° 30 W, about 175.0 feet to the point or place of beginning, be said dimensions and courses, more or less.
C. 
For the purposes of this chapter, the word "vessel" includes every description of watercraft, including nondisplacement craft and seaplanes used or capable of being used as means of transportation on water.
D. 
Nothing contained in § 80-3B shall restrict the owner or lessee of real property adjoining the waters of Greenwood Lake from using said waters for such purpose, provided that all other ordinances relating to boat storage have been complied with.
A. 
An person violating any provision of this chapter shall, upon conviction thereof, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of a violation of this chapter shall constitute, for each day of the offense is continued, a separate and distinct offense hereunder.
B. 
In addition to the foregoing penalties, any vessel may be removed from the place of violation and stored by an authorized agent for the Village, and all charges for removal or storage shall become a lien against the boat or other property so removed, as the word "lien" is defined under the provisions of the Lien Law of the State of New York.
