A. 
This chapter is hereby adopted pursuant to the provisions of § 10 of the NYS Municipal Home Rule Law.
B. 
The intent and purpose of this chapter is to facilitate the location of an emergency along the various roads and highways in the Town of Coxsackie by EMS, police and fire services and to facilitate the reporting of emergencies and the dispatching of emergency vehicles and personnel by the County 911 Center to the emergency. The Town Board of Coxsackie has determined that the enumeration of all buildings and structures within the Town for this purpose will promote the public health, safety and general welfare. In order to effectuate the efficient and accurate enumeration of all buildings and structures, the Town Board hereby enacts this chapter.
Within 90 days of the effective date of this chapter, the owners of all buildings and structures in the Town of Coxsackie shall affix or display the assigned 911 number to the building or structure as set forth in this section.
A. 
The property owner has the responsibility to affix the E-911 number as provided for in Subsections B and C, as set forth hereafter, and all cost associated therewith shall be borne by the owner.
B. 
The size of the figures comprising the numbers shall be at least four inches in height and 1/2 of an inch wide and shall be placed on the front of said building or structure in a prominent and conspicuous place and in such a manner as to be plainly legible from the center of the street at all times between sunrise and sunset. The color of said figures shall be in sharp contrast to the color of their background.
C. 
The numbers shall be so placed that they will not be obstructed by trees, shrubbery, porches or other extensions of the building or structure.
D. 
Whenever practical, said number is to be displayed near some light or source of illumination so that it may be readily seen at night.
E. 
Where the structure on which the number is to be displayed is more than 75 feet from the edge of the right-of-way, whether improved or not, of the street or road serving the building or structure, the number shall, in addition to the other requirements of this chapter, be displayed on a sign, with numbers at least four inches in height and 1/2 of an inch wide, readily visible from the road or street and in no event further back than 25 feet from said road or street right-of-way.
F. 
Any dispute or question as to the correct E-911 number for a structure or building shall be determined by the Greene County 911 Coordinator. The owner will contact that office directly and comply with the numbering assigned by them.
A. 
Due to the likelihood that residences in private developments will have the need to call 911 and request emergency services, the owners of private roads must comply with the provisions of this chapter simultaneously with their development of a project.
B. 
Any developer building a private road or a residence on a private road shall at the time a building permit is issued contact the County 911 Office and obtain the 911 address for that road or residence. The road name, temporary or permanent, must be clearly marked at the entrance from an existing town, county or state road entrance. Each residence or structure under construction must be clearly marked at the edge of the road with the 911 number in accordance with § 88-2.
C. 
Erection and maintenance of permanent road signs shall be required of the owner or majority of owners of any private road or development. At the request of the owner or majority of the owners of a private road, and upon receipt of a fee sufficient to cover the cost of materials and labor as determined by the Town, the Town may fabricate, erect and thereafter maintain a road name sign at the intersection of the private road and any public street. The erection of the road name signs shall be done according to National Emergency Number Association (NENA) standards.
A. 
Any owner of a building or structure within the Town of Coxsackie who refuses or neglects to properly number said building or structure or pay the fee for a private road sign outlined in § 88-3 shall be deemed in violation of this chapter. Said owner shall be notified of the violation of this chapter.
B. 
In the event of the neglect or refusal of any owner, after notice, to cause said structure or building to be properly numbered, the Town of Coxsackie Code Enforcement Officer may cause said structure or building to be properly numbered.
C. 
The Town of Coxsackie does hereby authorize the enforcement of the provisions of this chapter by designating the Code Enforcement Officer as the enforcement official when he discovers that there has been a lack of compliance with the provisions of this chapter. The Code Enforcement Officer is designated thereafter as the enforcement official for the service of notices, issuance of summonses and the prosecution of violations.
D. 
The Town Code Enforcement Officer shall receive information regarding unmarked or improperly marked buildings and structures and shall promptly investigate such.
E. 
Upon discovery of a violation of this chapter, the Code Enforcement Officer shall give notice of such violation by affixing a copy of the notice of violation to the entrance of the main structure on the premises or by certified mail, return receipt requested, to the last known address of the purported owner. The owner shall have 30 days after service within which to comply with the posting provisions of this chapter.
F. 
In the event that the owner fails to comply within the aforementioned thirty-day period, he or she shall be provided notice to show cause before the designated official, at a stated time and place, why said person should not be found in violation of this chapter and fined in accordance herewith.
Any violation of this chapter shall constitute an offense punishable by a fine not exceeding $25 for a first offense, not exceeding $100 for a second offense, and not exceeding $150 for any subsequent offenses.
The Town of Coxsackie Justice Court shall be responsible for collecting all fines.
The 911 signs provided for herein shall be considered exempt signs relative to the provisions of § 201-59, Exempt signs, of the Code of the Town of Coxsackie.
