As used in this article, the following terms shall have the meanings indicated:
GARBAGE
The same meaning given in § 282-1.
OTHER WASTE MATERIAL
All refuse, other than garbage and rubbish, including, but not limited to, building products, construction remnants or other such waste commonly produced and/or associated with the construction and/or remodeling of buildings and/or structures.
RUBBISH
The same meaning given in § 282-1.
A. 
No garbage, rubbish, recycling, or other waste matter shall be permitted or otherwise stored on the exterior of any building except in suitable, durable, easily cleaned, insect-free and rodent-resistant, watertight, leakproof garbage, rubbish, and other waste material receptacles, with tight-fitting covers, for the storage of such materials, until such materials are removed from the premises for disposal.

B. 
All such receptacles, as set forth in Subsection A hereof, shall at all times when on the exterior of the premises remain sealed with tight-fitting covers. It shall be a violation of this section to allow empty, partially filled containers and/or containers filled in any manner or degree with garbage, rubbish or other waste material to remain on the exterior of the premises with the cover or seal partially or fully open.
C. 
The exterior of all buildings and/or businesses in the Borough shall be maintained in a clean, safe and sanitary condition, free from any accumulation of garbage, rubbish or other waste material.
D. 
All containers, receptacles or dumpsters for garbage, rubbish and/or other waste material, if designed with drain plugs, shall have such drain plugs in place and closed except during cleaning. Every such container, receptacle and/or dumpster shall be kept covered, except when being filled or emptied. All such garbage, rubbish or waste material shall be removed promptly from the premises so as not to create a nuisance or health hazard, and each such container, receptacle or dumpster shall, immediately upon emptying, be properly and adequately cleaned.
E. 
All buildings not currently serviced by the Borough's contract with its private refuse hauler shall have an adequate number of containers, receptacles or dumpsters of sufficient size to handle safely and adequately all garbage, refuse and other waste material generated by the building and/or the tenants thereof.
F. 
All buildings not currently serviced by the Borough's contract with its private refuse hauler shall have in place contracts, agreements or other arrangements for the safe, legal and proper disposition of the garbage, refuse and other waste material being generated by the building and/or the tenants thereof.
G. 
The pickup and delivery of empty, full or partially full containers, receptacles or dumpsters for garbage, rubbish or other waste material to or from a building in the Borough shall be permissible between the hours of 6:00 a.m. and 11:00 p.m., prevailing time.
H. 
Each and every building owner and/or business located in the Borough not currently covered by the Borough's contract with its private refuse hauler shall file with the Borough, on a form approved by the Borough, certification under oath that safe, legal and proper arrangements have been made for the disposition of garbage, refuse and other waste material which is being generated by it or the occupants of its building in the Borough. Each and every existing building owner and/or business located in the Borough on the effective date of this section shall be in compliance with all terms of this section within 30 days of its enactment. Thereafter, each building owner and/or business shall be in compliance with this section at the time a certificate of occupancy is issued or within 10 days of establishing a business address within the Borough.
I. 
All garbage, rubbish and recycling stored on the exterior of any building shall, if possible, be stored in the rear of the property. If storage in the rear of the house is not possible due to house location, or lot topography, garbage, rubbish and recycling may also be stored on the side of the house. Garbage, rubbish, and recycling is only ever permitted in front of the house if it is in the driveway area nearest the house. However, the Borough Manager may, upon satisfactory proof that a hardship exists, grant a waiver of the storage location restriction to such a resident who applies for a waiver in advance of the violation.

J. 
All garbage, rubbish, or recycling for which a container is not available must be stored inside a structure until it is placed at the curb for collection.
