As used in this article, the following terms shall have the
meanings indicated:
OCCUPANT
Any person over the age of 12 who resides in the dwelling
unit.
QUALIFYING DWELLING UNIT
Any dwelling unit in the Borough of Green Tree, being a single-family
unit or a unit containing two to five multifamily dwellings, wherein
all of the occupants over the age of 12 are certified by a physician
licensed in the Commonwealth of Pennsylvania to be suffering from
a disability which prevents such occupant or occupants from being
able to place garbage and refuse at curbside.
The Borough of Green Tree hereby authorizes direct payment to
the refuse contractor under contract with the Borough on behalf of
the occupants of a qualifying dwelling unit, meeting all other requirements
of eligibility provided for herein, of the additional payment made
to the refuse contractor for pickup of garbage and refuse at the backyard
of the dwelling unit rather than at curbside.
All occupants of qualifying dwelling units shall sign and submit
an application to be approved for backyard pickup under the provisions
of this article to be supplied by the Borough of Green Tree. Attached
to the form shall be an affidavit by a physician licensed in the Commonwealth
of Pennsylvania, certifying that each and every occupant of the dwelling
unit is disabled and that because of such disability the occupants
of the dwelling unit cannot place the usual and customary garbage
and refuse at curbside during the entire period for which reimbursement
is sought.
The Borough Manager shall administer the program set forth in
this section and shall:
A. Develop applicable rules, regulations and application forms, including
due dates for applications;
B. Review all applications and supporting documentation, including affidavits
of physicians; and
C. Approve or deny each and every application under this article.
Any person aggrieved by a decision of the Borough Manager may
appeal that decision to Council within 30 days of the Borough Manager's
decision. Council may decide the issue or refer the matter to a committee
of Council for recommendation to Council. The decision of Council
shall be final, and any appeal therefrom shall be under the Local
Agency Law.
The payment authorized by this section shall be one for payment
for the difference between the charge for backyard pickup and curbside
pickup, based upon the contracted amount set forth in the Borough's
contract with the refuse contractor.
Any information gained by the Borough Manager, his or her deputy,
or any other official agent or employee of the Borough, as a result
of any application, investigation or verification required or authorized
by this article, shall be confidential, except in accordance with
proper judicial order or as otherwise provided by law.
The program set forth in this article shall continue until terminated
by Council.
