It is the purpose of this article to establish standards for dedication of roadways by developers in the Township of Allamuchy and to delineate responsibility for maintenance of such roadways prior to dedication.
A. 
All developers shall be responsible for maintaining roadways within their developments prior to the dedication of those roadways to the Township of Allamuchy. Such responsibility shall include, but not be limited to, general maintenance and cleaning, snow removal and removal of rubbish and hazardous conditions from the roadways.
B. 
The Township of Allamuchy shall have the right to enter any such roadways on an emergency basis in the event of a default by the developer of the developer's obligations hereunder. In the event that the Township of Allamuchy performs such work as a result of the developer's default, then the cost of the work performed by the Township of Allamuchy shall be assessed to the developer.
The following standards and requirements shall be applicable to developers seeking to dedicate roadways to the Township of Allamuchy. The requirements set forth herein are in addition to and not in lieu of any requirements imposed by statute.
A. 
Dedication of roadways shall be subject to the review and recommendation of the Township Attorney and Township Engineer and final approval by the Mayor and Council.
B. 
A developer seeking to dedicate a roadway to the Township of Allamuchy shall submit a proposed deed of conveyance of the roadways to the Township Attorney. Said deed of conveyance shall include a full metes and bounds description of all roadways, easements, sight triangles and other dedications applicable thereto. The metes and bounds description shall also be submitted to the Township Engineer for review and approval.
C. 
If the property to be dedicated is owned by a partnership or corporation rather than an individual, the developer shall also submit a corporate or partnership affidavit of title and corporate or partnership resolution authorizing the conveyance. If the property is owned by an individual, the individual shall submit an affidavit of title.
D. 
The developer shall submit a policy of title insurance in the amount of $1,000, insuring the developer's ownership of the roads, easements and/or other property interests to be conveyed as well as the conveyance or sale of the same to the Township of Allamuchy.
E. 
The developer shall submit to the Township Attorney for review and approval a two-year maintenance bond describing the improvements to be conveyed and obligating the developer to maintain the same. The amount of the maintenance bond shall be set by the Township Engineer after inspection of the improvements.
A. 
Upon review and approval by the Township Attorney and Township Engineer, the Mayor and Council may accept the dedication by adopting a resolution accepting the deed to the improvements. Thereafter, the deed shall be recorded in the office of the Warren County Clerk.
B. 
The developer shall remain obligated to maintain the roads in accordance with § 270-20 until such time as the Mayor and Council pass the resolution accepting the dedication.
