A. 
Compliance with section prerequisite to occupancy or leasing. No person shall occupy as owner-occupant or let to another for occupancy any dwelling or dwelling unit, for the purpose of living, sleeping, cooking, or eating therein, which does not comply with the requirements of this section.
B. 
Kitchen sink. Every dwelling shall contain a kitchen sink in good working condition and properly connected to a water and sewer system according to the standards set forth in this section or any rules or regulations promulgated under this section.
C. 
Water closet. Every dwelling unit, except as otherwise permitted under Subsection D, shall contain a room which affords privacy to a person within such room and which is equipped with a flush water closet and a lavatory basin in good working condition and properly connected to a water and sewer system according to the standards set forth in this section or any rules or regulations promulgated under this section.
D. 
Bathroom. Every dwelling unit shall contain, within a room which affords privacy to a person within such room, a bathtub or shower in good working condition and properly connected to a water and sewer system according to the standards set forth in this section or any rules or regulations promulgated under this section.
E. 
Hot and cold water. Every kitchen sink, lavatory basin, and bathtub or shower required under the provisions of Subsections B through D shall be properly connected with both hot and cold water lines.
F. 
Water heating facilities. Every dwelling shall have supplied water-heating facilities which are properly installed, and maintained in safe and good working condition, are properly connected with the hot water lines required and are capable of heating water to such temperature as to permit an adequate supply of water so that it may be drawn at any time at every required kitchen sink, lavatory basin, bathtub, or shower at a temperature of not less than 120° F.
G. 
Plumbing Code.[1]
(1) 
No dwelling or dwelling unit shall be deemed to comply with the requirements of this chapter relating to plumbing and plumbing fixtures unless it complies with the Plumbing Code of the City.
(2) 
Any additions or alterations to the plumbing or plumbing fixtures of dwellings shall be in accordance with the Plumbing Code of the City.

H. 
Garbage and rubbish. Every dwelling unit shall be supplied with adequate rubbish and garbage storage facilities as required by other City ordinances.[2]

I. 
Means of egress. Every dwelling unit shall have access to at least two remote means of egress at ground level which are, at all times, unobstructed; an unobstructed window may serve as one such means of egress. This shall not be required for apartments at ground level having less than 250 square feet of habitable floor area.

J. 
Accessory buildings. An accessory building shall comply with all requirements of the Uniform Building Code,[3] Chapter 350, Zoning and Development, and any other ordinances or codes of the City.

A.

No person shall occupy as owner-occupant or let to another for occupancy any dwelling or dwelling unit for the purpose of living therein which does not comply with the requirements of this section. Light, ventilation and heating, as required by this section, are hereby required for every habitable room.

B. 
Window to outside. Every habitable room shall have at least one window or skylight facing directly to the outdoors. The minimum total window area, measured between stops, for every habitable room shall equal at least 10% of the floor area of such room. Whenever walls or other portions of structures face a window of any such room and such light-obstruction structures are located less than five feet from the window and extend to a level above that of the ceiling of the room, such window shall not be deemed to face directly to the outdoors and shall not be included as contributing to the required minimum total window area. Whenever the only window in a room is a skylight-type window in the top of such room, the total window area of such skylight shall equal at least 15% of the total area of such room.
C. 
Windows to open. Every habitable room shall have at least one window or skylight which can easily be opened to 45% of total window area, or such other device as will adequately ventilate the room and is approved by the City Manager or his authorized representative.
D. 
Bathrooms. Every bathroom and water closet compartment shall comply with the light and ventilation requirements for habitable rooms contained in Subsections B and C, except that no window or skylight shall be required in adequately ventilated bathrooms and water closet compartments equipped with a ventilation system which is kept in continuous operation while in use and approved by the City Manager or his authorized representative.
E. 
Electrical outlets and fixtures. Where there is electric service available from power lines which are not more than 300 feet away from a dwelling, every habitable room of such building shall contain at least two separate floor or wall-type electric convenience outlets, or one such convenience outlet and one supplied ceiling-type electric light fixture. Every water closet compartment, bathroom, laundry room, furnace room, and public hall shall contain at least one supplied ceiling or wall-type electric light fixture.
F. 
Halls and stairways to be lighted. Every public hall and stairway in every multiple dwelling shall be adequately lighted at all times.
G. 
Electrical Code compliance. No dwelling or dwelling unit shall be deemed to comply with the requirements of this chapter relating to electric wiring and facilities unless they comply with the Electrical Code of the City.[1]

H. 
Heating facilities. Every dwelling shall have heating facilities which are properly installed, are maintained in safe and good working condition, and are capable of safely and adequately heating all habitable rooms, bathrooms, water closet compartments in every dwelling unit located therein to a temperature of at least 70° F., at a distance three feet above floor level. No dwelling or dwelling unit shall be deemed to comply with the requirements of this chapter relating to heating facilities unless:
(1) 
Central heating systems. When the dwelling or dwelling unit is heated by a central heating system, every heat duct, steam pipe, and hot water pipe is free of leaks and functions so that adequate heat is delivered where intended.
(2) 
Space heaters; venting. When the dwelling or dwelling unit is heated by space heaters, every space heater burning solid, liquid, or gaseous fuel shall be properly vented to a chimney or duct leading to outdoor space.
(3) 
Space heaters; coal or wood burning; fire prevention. Every coal or wood-burning space heater has a fire-resistant panel beneath it.
(4) 
Space heaters; insulation against overheating. Every space heater located close to a wall is equipped with insulation sufficient to prevent overheating of the wall.
(5) 
Space heaters; smoke pipes. Every space heater smoke pipe is equipped with guards made of metal or other nonflammable material at the point where the pipe goes through the wall, ceiling or partition.
(6) 
Chimneys and smoke pipes. Every smoke pipe and every chimney is adequately supported, reasonably clean, and maintained in such condition that there will be no leak or backing up of noxious gases.
(7) 
Alterations. Any additions or alterations to the heating or heating facilities of any dwelling shall be in compliance with the Building Code of the City.[2]

I. 
Protection against insects. For protection against mosquitoes, flies, and other insects, every door opening directly from a dwelling unit to outdoor space shall have a screen with a closing device; an exception to this requirement will be made where the dwelling unit is equipped with a central refrigerated air system. Every window or other device with openings to outdoor space, used or intended to be used for ventilation, shall likewise be supplied with screens.

J. 
Basement windows; rodentproofing. Every basement window used or intended to be used for ventilation, and every other opening to a basement or crawl space which might provide an entry for rodents, shall be supplied with a screen or such other device as will effectively prevent their entrance.
A. 
Compliance with section prerequisite to occupancy or leasing. No person shall occupy as owner-occupant or let to another for occupancy any dwelling or dwelling unit, for the purpose of living therein, which does not comply with the requirements of this section.
B. 
Engineering requirements. The premises of every dwelling or dwelling unit shall comply with all requirements of the City Engineer with respect to grading, drainage and finish elevations.
C. 
Dwelling units to be fit for occupancy. No owner shall occupy or let to any other occupant any vacant dwelling unit unless it is clean, sanitary, and fit for human occupancy.
D. 
Foundations, floors, walls and roof.
(1) 
Every foundation, floor, wall, ceiling, and roof shall be reasonably weathertight, watertight, and rodentproof; shall be capable of affording privacy; and shall be kept in good repair.
(2) 
No dwelling or dwelling unit shall be deemed to comply with the requirements of this chapter relating to foundations, floors, walls, and roofs unless:
(a) 
The foundation elements adequately support the building at all points.
(b) 
Every floor is free of holes and wide cracks which might admit rodents, or which constitute a possible accident hazard.
(c) 
Every floor is free of loose, warped, protruding, and rotting floor boards.
(d) 
Every exterior wall is free of holes, breaks, loose or rotting boards and timbers, and any other conditions which might admit rodents, rain, or snow to the interior portions of the wall or to the interior spaces of the dwellings.
(e) 
Every interior wall and ceiling is free of holes and large cracks.
(f) 
Every interior wall and ceiling is free of loose plaster or other structural material, the collapse of which might constitute an accident hazard.
(g) 
Plaster, paint, and all other surface materials are of such character as to be easily cleanable and are reasonably smooth, clean, and tight.
(h) 
The roof is tight and has no defects which might admit rain or snow.
(i) 
Any additions or alterations to the dwelling structure shall be in compliance with the Building Code of the City.[1]

E. 
Windows and doors. Every window, exterior door, and basement hatchway shall be reasonably weathertight, watertight, and rodentproof, and shall be kept in sound working condition and good repair.
F. 
Stairs and porches. Every inside and outside stair, every porch, and every appurtenance thereto shall be so constructed as to be safe to use and capable of supporting the load that normal use may cause to be placed thereon.
G. 
Bathroom floors. Every water closet compartment floor surface shall be constructed and maintained so as to be reasonably impervious to water and so as to permit such floor to be easily kept in a clean and sanitary condition.
H. 
Discontinuance of services or facilities. No owner, operator, or occupant shall cause any service, facility, equipment, or utility which is required under this chapter to be removed from or shut off or discontinued for any occupied dwelling, let or occupied by him, except for such temporary interruption as may be necessary while actual repairs or alterations are in process, or during temporary emergencies when discontinuance of service is approved by the City Manager or his authorized representative.
I. 
Housing built before 1978 may contain lead-based paint. Lead from paint, paint chips, and dust can pose health hazards if not managed properly. Lead exposure is especially harmful to young children and pregnant women. Before renting pre-1978 housing, lessors must disclose the presence of known lead-based paint and lead-based paint hazards in the dwelling. Lessees must also receive a federally approved pamphlet on lead poisoning prevention.

A. 
Compliance with section prerequisite to occupancy or leasing. No person shall sell for occupancy or let to another for occupancy any dwelling or dwelling unit, for the purpose of living therein, which does not comply with the requirements of this section.
B. 
Floor space per occupant. Every dwelling unit shall contain at least 150 square feet of floor space for the first occupant thereof, and at least 100 additional square feet of floor space for every additional occupant thereof, the floor space to be calculated on the basis of total habitable room area.
C. 
Sleeping room floor space. In every dwelling unit of two or more rooms, every room occupied for living, dining and sleeping purposes by one occupant shall contain at least 80 square feet of floor space, and every room occupied for sleeping purposes by more than one occupant shall contain at least 45 square feet of floor space for each occupant thereof.
D. 
Ceiling height. At least 1/2 of the floor area of every habitable room shall have a ceiling height of at least seven feet, and the floor area of that part of any room where the ceiling height is less than five feet shall not be considered as part of the floor area in computing the total floor area of the room for the purpose of determining the maximum permissible occupancy thereof.
E. 
Basement dwelling units. Dwelling units located in basements shall be provided with not less than two separate means of egress.
F. 
Care of premises. Open storage of abandoned automobiles, scrap metal, household appliances, junk and building materials not being used in conjunction with a current, ongoing project will not be permitted. It will be the responsibility of the landowner to ensure compliance with this section and the responsibility of the City Manager or his authorized representative to ensure adherence to the requirements contained herein.
