A. 
As used in this chapter, the following terms shall have the meanings indicated:
PERSON
Any natural person, association, partnership, firm or corporation.
TRANSIENT RETAIL BUSINESS
Engaging in peddling, canvassing, soliciting or taking of orders, either by sample or otherwise, for any goods, wares or merchandise, including magazines, books, periodicals or personal property of any nature whatsoever, for future delivery or for service to be performed at that time or in the future upon any of the streets or sidewalks or from house to house within the Township of South Strabane.
B. 
In this chapter, the singular shall include the plural and the masculine shall include the feminine and the neuter.
No person shall engage in any transient retail business within the Township of South Strabane without first having obtained from the Township Secretary a license, for which a fee, for the use of the Township, shall be charged in the amount of $25 per month or fractional part thereof.
A. 
No license fee shall be charged under this section to farmers selling their own produce; for the sale of goods, wares and merchandise donated by the owners thereof, the proceeds whereof are to be applied to any charitable or philanthropic purpose; or to any manufacturer or producer in the sale of bread and bakery products, meat and meat products, or milk or milk products, but all persons exempted hereby from payment of the license fee shall be required to register with the Township Secretary and to obtain a license without the fee.
B. 
Any person dealing in one or more of the hereinabove-mentioned exempted categories and selling other goods, wares or merchandise not so exempted shall be subject to the payment of the license fee fixed by this section for his activities in connection with the sale of goods, wares and merchandise not in such exempted categories.
C. 
Every license issued under the provisions of this chapter shall be issued on an individual basis to persons engaged in such business; every individual shall obtain a separate license, issued to him in his name, and the license fee hereby imposed shall be applicable to every such individual license.
A. 
Every person desiring to engage in transient business in the Township of South Strabane shall first make application to the Township Secretary for a license. Upon such application, such person shall give:
(1) 
His name and address;
(2) 
His previous criminal record, if any;
(3) 
The name of the person for whom he works, if any;
(4) 
The type of goods, wares and merchandise he wishes to deal with;
(5) 
The length of time for which he wishes to be licensed;
(6) 
The type and license number of vehicles he uses, if any; and
(7) 
The number of helpers he has.
B. 
Where a person makes application for himself and one or more helpers, all applicable personal information specified above shall be given for each helper, and an individual license shall be required for each helper. No license issued under this chapter shall be transferable from one person to another.
A. 
Upon making application therefor and paying the prescribed fee, as herein specified, the Township Secretary shall refer such application to the Chief of Police, who shall institute such investigation of the applicant's business and moral character as he deems necessary for the protection of the public safety; such investigation shall not require more than 72 hours. If, upon such investigation, the applicant's business and moral character are found to be satisfactory as reported by the Chief of Police to the Township Secretary, the Township Secretary shall thereupon issue the license. Upon the refusal or failure to act on an application within such time, the applicant may appeal to the Board of Supervisors for relief.
B. 
Such license shall contain the information required to be given upon the application therefor. Every license holder shall at all times, when engaged in a transient retail business from house to house or upon any street, alley, sidewalk or public grounds in the Township, carry such license upon his person and shall exhibit such license, upon request, to all police officers, Township officials and citizens.
No person engaged in any transient retail business shall:
A. 
Sell any product or type of product not mentioned in his license.
B. 
Hawk or cry his wares upon any street, alley, sidewalk or public grounds in the Township.
C. 
When selling from a vehicle, stop or park such vehicle upon any street or alley in the Township for longer than necessary in order to sell therefrom to persons residing in the immediate vicinity.
D. 
Park any vehicle upon any street or alley in the Township for the purpose of sorting, rearranging or cleaning any of his goods, wares or merchandise or of disposing of any carton or wrapping material or of any stock or wares or foodstuffs which shall have become unsalable through handling, age or otherwise.
The Township Secretary is hereby given authority to suspend or revoke any license issued under this chapter when he shall deem such suspension or revocation to be in the interest of the public health, safety, welfare or morals or for violation of any provision of this chapter or for giving false information in any application for a license hereunder. Appeals from any suspension or revocation may be made to the Board of Supervisors at any time within 10 days after such suspension or revocation. No part of a license fee shall be refunded to any person whose license shall have been suspended or revoked.
Any person who shall violate any of the provisions of this chapter shall, upon conviction thereof, be punishable as provided in § 1-2, Summary proceedings, of the Code of the Township of South Strabane.
