The County of Suffolk hereby elects, pursuant to § 202-a(2)
of the New York Labor Law, to grant any exempt County employee, who
works for an average of 20 hours or more per week, up to seven days'
paid leave to undergo a medical procedure to donate bone marrow, such
leave to be in addition to any other sick or annual leave allowed
by any other rule, regulation, law, or agreement.
Any exempt employee who is actually donating organs, organ parts, or tissue shall be allowed up to 30 days' paid leave to undergo a medical procedure to donate an organ (such as a kidney, partial liver, or lung), organ part, or tissue, anything in Chapter
935 of the Suffolk County Code to the contrary notwithstanding.
Employee donors shall submit written verification by a physician
for the purpose and length of each such leave requested by the employee
to donate organs, organ parts, bone marrow, or tissue, as the case
may be, in order to be eligible to participate under this program.
The County of Suffolk shall not retaliate against any employee
for requesting or obtaining a leave of absence as provided in the
program established by this article.
All other fringe benefits extended to any exempt employees under Chapter
935 of the Suffolk County Code shall remain applicable and in full force and effect.
The Suffolk County Department of Audit and Control is hereby authorized, empowered, and directed, pursuant to §
C5-2I of the Suffolk County Charter, to take such measures as shall be necessary and appropriate to effectuate the above-described reimbursement of lost time to volunteer organs, bone marrow, and/or tissue.
The County Director of Labor Relations is hereby authorized,
empowered, and directed to issue and promulgate such regulations as
shall be necessary to implement the provisions of this article.
The benefits granted by this article shall be applicable to
anyone who shall donate or has donated organs, bone marrow or tissue
on or after the effective date of this article.
