A. 
The Village of Belleville, in complying with the Americans with Disabilities Act (ADA), 42 U.S.C. § 12101, has developed a plan by which access to all Village programs, facilities, services and employment is guaranteed to all citizens. A transition plan has been adopted by the Village Board and is available from the Village Clerk/Treasurer. An ADA Coordinator has been appointed and an ADA Compliance Committee established. Concerns and/or complaints can be addressed to the ADA Coordinator.
B. 
The Village Clerk/Treasurer or his or her designee shall serve as the Americans with Disabilities Act Coordinator and shall accept all grievances filed with respect to the Americans with Disabilities Act and make decision thereon in consultation with the Village Attorney within 30 days of the filing of such grievance. Such decision may be appealed to the Village President in accordance with the procedure established in this article.
C. 
The ADA Compliance Committee shall be appointed by the Village President, subject to confirmation by the Village Board, at the Village Board's organizational meeting. The Committee members shall serve a three-year term.
(1) 
The ADA Compliance Committee shall, if possible, have a representative from the following fields:
(a) 
Business and/or nonprofit organization.
(b) 
School district.
(c) 
Disabled representative.
(d) 
Elected official.
(e) 
Health, medical and emergency first responders.
(2) 
The Village ADA Compliance Committee consists of the Village Clerk/Treasurer, Public Works Director, Librarian, Police Chief, Village Board and citizens. The ADA Compliance Committee will be responsible for keeping current the notice under ADA, determining actions to be taken to implement ADA, reviewing complaints, and completing the self-evaluation of services, programs, policies and procedures required by ADA.
D. 
Village letterhead, website, electronic mail, and other applicable printed notices should contain the words "An equal opportunity employer."
E. 
The Village Clerk/Treasurer shall make every effort to post ADA Compliance Committee meetings a minimum of 48 hours prior to the meeting. All Committee meetings shall be posted in compliance with Wisconsin's Open Meeting Law.[1]

A. 
All complaints alleging discrimination on the basis of disability in the provision of services, activities, programs, or benefits by the Village shall be submitted in writing to the ADA Coordinator within 60 calendar days of the event or incident. A standard complaint form is available. Alternative means of filing complaints, such as personal interviews or a tape recording of the complaint, will be made available for persons with disabilities upon request. The ADA Coordinator will meet with the complainant within 15 calendar days of receiving the complaint to discuss the complaint and possible resolutions. A written decision by the ADA Coordinator will be rendered within 15 calendar days of the meeting. Complaints alleging discrimination in employment on the basis of disability shall be handled by the Village Clerk/Treasurer under Section 1.2 of the Village's Employee Manual.
B. 
If the complaint cannot be resolved to the satisfaction of the complainant by the ADA Coordinator, the complainant may appeal the decision within 15 calendar days after receipt of the ADA Coordinator's decision to the Village President.
C. 
Within 15 calendar days after receipt of the appeal, the Village President will meet with the complainant to discuss the complaint and possible resolutions. Within 15 calendar days after the meeting, the Village President will respond in writing and, where appropriate, in a format accessible to the complainant with a final resolution of the complaint.
D. 
A record of each complaint and action taken at each step of the grievance process will be maintained for at least seven years.
E. 
The use of this grievance procedure is not a prerequisite to the pursuit of other remedies, including the filing of a complaint with the United States Department of Justice or any other appropriate agency, or the commencement of a lawsuit.
