There is hereby established by the Board of Supervisors of Fairview
Township a Planning Commission of five members to be appointed by
the Board of Supervisors, none of whom are officers or employees of
the Township. All members of the Planning Commission shall serve without
compensation, but may be reimbursed for necessary and reasonable expenses.
The term of each of the members of the Planning Commission shall
be for four years, or until his or her successor is appointed and
qualified, except that the terms of the members first appointed pursuant
to this chapter shall be as follows: two members shall be appointed
to serve for a term of one year; one member shall be appointed to
serve for a term of two years; one member shall be appointed to serve
for a term of three years; and one member shall be appointed to serve
for a term of four years; and thereafter annually, upon the expiration
of the term of each member, the Board of Supervisors shall appoint
a successor for a full four-year term. All of the members of the Planning
Commission shall be residents of Fairview Township.
The Chairman of the
Planning Commission shall promptly notify the Board of Supervisors
of any vacancies occurring on the Planning Commission, and such vacancies
shall be filled by the Board of Supervisors for the unexpired term.
If a vacancy shall occur otherwise than by expiration of term, it
shall be filled by appointment for the unexpired term as provided
in this chapter.
The Planning Commission shall elect its own Chairman and Vice
Chairman and create and fill such other offices as it may determine.
Officers shall serve annual terms and may succeed themselves. The
Planning Commission may make and alter bylaws and rules and regulations
to govern its procedures consistent with the ordinances of Fairview
Township and the laws of the Commonwealth of Pennsylvania. The Planning
Commission shall keep a full record of its business and shall annually
make a written report by March 1 of each year of its activities to
the Board of Supervisors. Interim reports may be made as often as
may be necessary, or as requested by the Board of Supervisors.
Any member of the Planning Commission, once qualified and appointed,
may be removed from office for malfeasance, misfeasance or nonfeasance
in office or for other just cause by a majority vote of the Board
of Supervisors taken after the member has received 15 days' advance
notice of the intent to take such a vote. A hearing shall be held
in connection with the vote if the member shall request it in writing.
Any appointment to fill a vacancy created by removal shall be only
for the unexpired term.
The Planning Commission shall have all of the powers and duties
conferred upon it by the Act of 1988, December 21, P.L. 1329, No.
170, 53 P.S. § 10101 et seq. (the Pennsylvania Municipalities
Planning Code), and such additional powers, duties and advisory functions
not inconsistent with the Pennsylvania Municipalities Planning Code.
