The words and phrases used in this article shall, for the purpose of this article, have the meanings respectively ascribed to them by Article I of the Vehicle and Traffic Law of the State of New York.
The Town Superintendent of Highways shall install and maintain traffic control devices when and as required under the provisions of this article to make effective the provisions of said article and may install and maintain such additional traffic control devices as he may deem necessary to regulate, warn or guide traffic under the Vehicle and Traffic Law of the State of New York subject to the provisions of §§ 1682 and 1684 of that Law.[1]

Every person convicted of a traffic infraction for a violation of any provision of this article which is not a violation of any provision of the Vehicle and Traffic Law of the State of New York shall, for a first conviction thereof, be punished by a fine of not more than $50 or by imprisonment for not more than 15 days, or by both such fine and imprisonment; for a second such conviction within 18 months thereafter, such person shall be punished by a fine of not more than $100 or by imprisonment for not more than 45 days, or by both such fine and imprisonment; upon a third or subsequent conviction within 18 months after the first conviction, such person shall be punished by a fine of not more than $250 or by imprisonment for not more than 90 days, or by both such fine and imprisonment.[1]

No person shall park a vehicle at any time upon any of the streets or parts of streets described below:

A. 
Commencing on the 25th day of May each year and continuing through the eighth day of September thereof, no person shall park a motor vehicle on either side of any of the following streets, parts of streets or the public rights-of-way adjacent thereto:
(1) 
Blue Factory Hill Road, from its intersection with Plank Road and proceeding easterly therefrom a distance of 600 feet.
(2) 
Banner Hill Lane, from its intersection with Blue Factory Hill Road and proceeding southerly therefrom a distance of 200 feet.
(3) 
Plank Road, commencing at a point 600 feet west of its intersection with Blue Factory Hill Road and running thence generally northerly and westerly therefrom a distance of 2,300 feet.
B. 
Exemption for cemetery purposes. The short-term parking of motor vehicles incidental to participation in or attendance at funeral, burial and/or memorial services at the cemeteries accessed by such roads shall be exempt from the aforesaid prohibition.
C. 
Winter parking; penalties.

(1) 
Seasonal parking prohibition. No person shall park a vehicle or trailer or place any object on a Town highway from October 1 until April 1 in such a way that it interferes with winter road maintenance, including but not limited to salting, sanding or plowing of any Town road.
(2) 
Ticketing. In addition to any police or peace officer authorized to issue violations under the Vehicle and Traffic Law, the Highway Superintendent is hereby authorized to issue parking tickets to such offenders.

In addition to any penalty contained in any other provision of law, any violation of this article shall render the owner of the unlawfully parked vehicle to be subject to a fine not to exceed $50. In addition, and pursuant to the authority granted by Vehicle and Traffic Law § 1660(a)(8), any vehicle parked in violation of this article may be towed or otherwise removed to a facility authorized by the Town of Poestenkill, and the owner of said vehicle shall be fully and solely liable for any and all charges for the removal, storage and redemption of such vehicle.
