§ 187-1 Purpose.

The purpose of this chapter is to create smoke-free zones at the Town parks and Town-owned open spaces.

§ 187-2 Definitions.

As used in this chapter, the following terms shall have the meanings indicated:
SMOKING
Using lighted tobacco and tobacco products, clove cigarettes and similar substances, including, without limitation, cigarettes, cigars and pipes.

§ 187-3 Smoke-free zones.

A. 
The following Town-owned areas, and any area owned by the Town of Lewisboro located within 75 feet thereof, are hereby designated as smoke-free zones:
(1) 
Picnic areas;
(2) 
Sport areas and fields, including but not limited to tennis facilities, volleyball facilities, baseball fields and basketball courts;
(3) 
Pool facilities; and
(4) 
Playgrounds.
B. 
Smoking is strictly prohibited in any smoke-free zone within the Town of Lewisboro.

§ 187-4 Penalties for offenses.

Any person upon conviction for a violation of this chapter shall be guilty of a violation as defined in Article 10, § 10.00, Subdivision 3, of the Penal law, which shall be punishable by payment of a fine not to exceed $100. In addition to these penalties, the Town Board may revoke for a period of one year any and all Town-issued park permits, licenses, and/or passes held by an individual in violation of this chapter. Further, any individual in violation of this chapter may be removed from, and refused admission to, any area stated in § 187-3A.
