As used in this chapter, the following terms shall have the
meanings indicated:
HAZARDOUS MATERIALS
Any substances or materials in a quantity or form which,
in the determination of the Emergency Management Coordinator or his
authorized representative, pose an unreasonable and imminent risk
to the life, health or safety of persons or property or to the ecological
balance of the environment and shall include but not be limited to
such substances as explosives, radioactive materials, petroleum products
or gases, poisons, etiologic (biologic) agents, flammables, corrosives
or materials listed in the hazardous substances list of the Pennsylvania
Department of Labor and Industry.
INCURRED COSTS
For purposes of this article, costs incurred by the Borough
of Port Vue shall include, but not be limited to, the following: actual
labor cost of Borough personnel, including workers' compensation benefits,
fringe benefits, administrative overhead, cost of equipment operation,
cost of special fire-extinguishing agents used and cost of any contracted
labor and materials. The costs incurred by the Borough Fire Department
for actual fire-suppression services which are normally or usually
provided by the Fire Department are excluded from recoverable costs
under this article.

The Volunteer Fire Department of the Borough of Port Vue is
hereby authorized to charge the person(s) found at fault or the owner(s)
of said property to be found at fault for the use of any necessary
hydraulic, fire and/or rescue equipment. Each use of said equipment
shall constitute a separate fee.

Expenses incurred by the Volunteer Fire Department to provide
fire protection and prevention shall be assessed and billed as follows:
A. Fires in dumpsters, rubbish, and trash areas will be billed to the
person(s) or owner(s) found at fault up to a maximum of $250.
B. Motor vehicle rescue or response may be billed to person(s) or owner(s)
found to be at fault up to a maximum of $500.
C. Motor vehicle fires shall be billed according to preset categories:
(1) Passenger vehicle, one engine response: $300.
(2) Passenger vehicle, rescue services: $300.
(3) Passenger vehicle, engine and rescue: $500.
(4) Commercial/industrial, one engine response: $500.
(5) Commercial/industrial, engine and rescue: $650.
(6) Commercial/industrial including hazmat: costs + 15%.
D. Standby response fee for utility services, which include, but are
not limited to, service interruption or breaks in electrical lines,
telephone lines, cable lines, utility poles, light standards or pipeline
breaks or leaks, or any other exigency which requires the Fire Department
to stand by while the utility company, cable company, or any other
entity that utilizes a pipeline, gas line, electric lines, telephone
poles or light standards in the Borough, shall be $50 per company
per hour. If the standby response occurs at multiple locations, then
the aforesaid fee is applicable at each location.

In addition to any fees due, any fine and/or penalty that results
from said fire shall also be paid, and any fees or expenses that are
imposed upon the Borough or the volunteer fire department by any local,
state or federal agency related to the same incident or occurrence
for which the Borough has provided its services and was assessed a
fee, may be included in the Borough's bill, or such fee may be
billed separately within 30 days of receipt of such local, state or
federal cost or fee. Such cost or fee shall be forwarded to the owner
of the realty or vehicle who shall have 30 days from the date of issuance
to reimburse the Borough for said costs and/or fees.
Payments received for the use of said equipment (hydraulic,
fire, rescue equipment) by the Volunteer Fire Department shall go
into the general fund of the Volunteer Fire Department to defer the
costs incurred in using said equipment and to purchase new equipment.
Council of the Borough of Port Vue is hereby authorized to,
from time to time, review requests from the Volunteer Fire Department
to increase the fees charged herein due to increases in costs for
the use of the aforesaid hydraulic, fire and or rescue equipment.
Any subsequent increase in the fees to be charged solely to the person(s)
and/or property owner(s) found to be at fault for the use of said
equipment shall be authorized by an ordinance adopted by the Council
of the Borough of Port Vue.
