Under and pursuant to the provisions of Section 201 of the Pennsylvania
Municipalities Planning Code, 53 P.S. § 10201, there is
hereby created a Borough Planning Commission to be composed of seven
members appointed in accordance with the provisions hereof.
All members of the Borough Planning Commission shall serve without
compensation, but may be reimbursed for necessary and reasonable expenses.
However, elected or appointed officers or employees of the municipality
shall not, by reason of membership thereon, forfeit the right to exercise
the powers, perform the duties or receive the compensation of a municipal
office held by them during such membership.
All members of the Borough Planning Commission shall be appointed
by the Borough Council. The term of each of the members of the Commission
shall be for four years, or until his successor is appointed and qualified,
except that the terms of the present members shall not be affected
by the provisions of this chapter. The Chairman of the Planning Commission
shall promptly notify the Borough Council concerning vacancies in
the Commission, and such vacancies shall be filled for the unexpired
term.
All of the members of the Planning Commission shall be residents
of the municipality. At least five of the members of the Planning
Commission shall be citizen members and hold no other Borough office.
Any member of a Planning Commission once qualified and appointed
may be removed from office for malfeasance, misfeasance, or nonfeasance
in office or for other just cause by a majority vote of the Borough
Council, taken after the member has received 15 days' advance notice
of the intent to take such a vote. A hearing shall be held in connection
with the vote, or the member shall request it in writing. Any appointment
to fill a vacancy created by removal shall be only for the unexpired
term.
The Borough Planning Commission shall elect its own Chairman and
Vice Chairman and create and fill such other offices as it shall determine.
Such officers shall serve annual terms and may succeed themselves.
The Borough Planning Commission shall have the powers and duties
as are designated to municipal planning commissions by Section 209.1
of the Pennsylvania Municipalities Planning Code, 53 P.S. § 10209.1,
and as such section is hereinafter amended.
The operating procedures, responsibility and jurisdiction of the
Planning Commission shall be governed by Article II, Section 201 et
seq., of the Pennsylvania Municipalities Planning Code,[1] and as it may be hereinafter amended, or by such rules
and regulations as the Planning Commission itself shall adopt, not
inconsistent with the Pennsylvania Municipalities Planning Code.
