A. All
solid waste, including trash which is defined to include paper, empty
food and drink containers, cans, pottery, glass and crockery, and
garbage which is defined to include all normal kitchen waste such
as vegetables, animal offal or by-products of vegetables and animal
products that does not include sewage and body waste, and rubbish
which is defined to include construction or repair refuse and other
normal house refuse (these definitions are not to be all-inclusive,
but are exemplary of the items included as solid waste), which shall
be generated within the City of Canton, Missouri, must be deposited
in a sanitary landfill that shall conform with Federal and State laws
and the rules, regulations and requirements of the Missouri Department
of Natural Resources.
B. Every
person, firm, partnership, corporation or unincorporated association
having a location of any kind within the corporate limits of the City
of Canton, Missouri, shall be required to use and to pay the fees
for the solid waste collection system as shall be determined by the
Board of Aldermen as set forth in this Chapter of the Municipal Code
of the City of Canton, Missouri.

The Board of Aldermen of the City of Canton, Missouri, shall
provide for the collection and disposition of all garbage, trash,
ashes, cinders, glass, papers, cans, refuse, and other waste material
of any kind or character within the City limits of the City of Canton,
Missouri.
Fees for collection of trash, rubbish and garbage shall be set
from time to time based on contractual agreements the City entered
into with various vendors that supply this service.

A. The
fee required as provided herein shall be shown on the City utilities
statement issued monthly by the City of Canton, Missouri, and the
fee as shown thereon shall become a part of that utilities statement
and shall be paid at the same time and in the same manner as other
utilities charged on that statement.
B. Any
person, firm, partnership, corporation or unincorporated association
not using City water and sewer services or other City utilities, but
otherwise required to pay the fees for trash, rubbish and garbage
collection as herein provided, shall be billed for the fees and shall
pay the fees at the City Office of the City of Canton within the first
fifteen (15) days of the month immediately following the month of
the bill.

The Board of Aldermen of the City of Canton, Missouri, shall
from time to time provide such rules and regulations pertaining to
the collection and disposition of all garbage, trash, ashes, cinders,
glass, cans, papers, wood, or other waste material of any kind or
character and shall make said rules and regulations known to the residents
of the City of Canton, Missouri, by appropriately publishing such
rules and regulations and by posting notice thereof within the City
of Canton, Missouri.

A. It
shall be unlawful and a violation of this Chapter for any person to
dispose or deposit any solid waste, as that term is defined by Section
260.200(34), RSMo., upon the surface of the ground or in any other
place in the City of Canton, Missouri, except in a solid waste processing
facility or solid waste disposal area having a permit as required
by Section 260.205, RSMo., in such a manner as to create a public
nuisance or adversely affect the public health.
B. No
person, firm, partnership, corporation, or unincorporated association
shall deposit solid waste in any dumpster or other authorized container
used for the deposit of solid waste not paid for or maintained by
that person or entity, unless the receptacle for the receipt of solid
waste is for public use.

C. Penalties For Violation.
1. Every day any violation of this Section shall continue shall constitute
a separate violation.
2. Any person, firm or corporation convicted of violating the terms of this Chapter shall be deemed guilty of a misdemeanor and upon conviction shall be subject to the penalties prescribed in Section
100.220 of the City Code.

Any person, firm, partnership, association or corporation who
or which shall violate provisions of this Article shall upon conviction
be deemed guilty of a misdemeanor.
