A. 
Definitions. As used in this article, the following terms shall have the meanings indicated:
OCCURRENCE
A discharge or threatened discharge of hazardous materials from a facility, equipment, vehicle or other instrumentality or thing within the jurisdiction of the Village of Flossmoor Fire Department.
RESPONSIBLE PARTY
A person who:
(1) 
Owns or has custody of the hazardous material that is involved in an incident requiring emergency action by an emergency response agency; or
(2) 
Owns or has custody of bulk or nonbulk packaging or a transport vehicle that contains hazardous material that is involved in an incident requiring emergency action by an emergency response agency; or
(3) 
Causes or substantially contributed to the cause of the incident.
B. 
Charge for services. Unless otherwise exempt, any responsible party shall be charged for services rendered by the Village of Flossmoor Fire Department for any occurrence at the rate set forth.
(1) 
Flossmoor Fire Department - hazardous materials occurrence:
(a) 
One hundred twenty-five dollars per hour per vehicle responding.
(b) 
Fifty dollars per hour for the Fire Chief responding.
(c) 
Thirty-five dollars per hour for all other responding personnel.
(d) 
Replacement cost value for any item expended for the necessary mitigation or resolution of the occurrence.
C. 
Additional charges. In the event that it is deemed by the Fire Chief of the Village of Flossmoor Fire Department or his designee that it is necessary in the mitigation or resolution of an occurrence for the Village of Flossmoor Fire Department to call in MABAS 24 Hazardous Materials Response Team and/or a separate, independent, specialized service or cleanup contractor, the responsible party shall be responsible for payment to the MABAS 24 Hazardous Materials Response Team and/or separate, independent, specialized service or cleanup contractor of all reasonable charges assessed by said team or contractor to complete the mitigation or resolution of the occurrence. The responsibility for this payment shall be in addition to any and all applicable charges assessed against the responsible party pursuant to this chapter.
D. 
Mutual aid charges. In the event it is deemed by the Fire Chief of the Village of Flossmoor Fire Department or his designee that it is necessary for the Village of Flossmoor Fire Department to request mutual aid assistance, the responsible party shall be charged, in addition to the rates set forth in § 150-5-1B(1), for all applicable charges assessed, for the services of each mutual aid company at the rate set forth:
(1) 
One hundred twenty-five dollars per hour per vehicle responding.
(2) 
Fifty dollars per hour for the Fire Chief responding.
(3) 
Thirty-five dollars per hour for all other responding personnel.
(4) 
Replacement cost value for any item expended for the necessary mitigation or resolution of the occurrence.

A. 
Advanced Life Support, Level 1 (ALS1), ALS1 is the transportation by ground ambulance vehicle and the provision of medically necessary supplies and services, including the provision of an ALS assessment or at least one advanced life support intervention.
(1) 
Base charge: $2,310.09.
(2) 
Per mile charge: $20.
B. 
Advanced Life Support, Level 2 (ALS2).
(1) 
ALS2 is the transportation by ground ambulance vehicle and the provision of medically necessary supplies and services, including (1) at least three separate administrations of one or more medication by intravenous push/bolus or by continuous infusion (excluding crystalloid fluids); or, (2) ground ambulance transport, medically necessary supplies and services, and the provision of at least one of the ALS procedures listed below:
(a) 
Manual defibrillation/cardioversion.
(b) 
Endotracheal intubation.
(c) 
Central venous line.
(d) 
Cardiac pacing.
(e) 
Chest decompression.
(f) 
Surgical airway.
(g) 
Intraosseous line.
(2) 
Base charge: $2,310.09.
(3) 
Per mile charge: $20.
C. 
Basic life support (BLS). BLS is transportation by ground ambulance vehicle and the provision of medically necessary supplies and services, including BLS ambulance services as defined by the state.
(1) 
Base charge. $2,135.70.
(2) 
Per mile charge: $20.
D. 
Fees for ALS1, ALS2 and BLS shall be automatically adjusted commencing May 1, 2023, and annually on May 1 each year thereafter pursuant to the annual cost report approved by the Illinois Department of Health and Family Services as submitted by the Village of Flossmoor Fire Department.
E. 
Necessary medical supply and services rendered, no transport by ground ambulance vehicle.
(1) 
Basic Life Support treatment without transportation: $200.
(a) 
This fee shall be charged after three occasions of such request without transport from the same individual within the same calendar year.
(2) 
Advanced Life Support treatment without transportation: $300.
(a) 
This fee shall be charged after two occasions of such request without transport from the same individual within the same calendar year.

A. 
Liability for costs. The following persons shall be jointly and severally liable for all costs of a specialized rescue team as set forth in this section:
(1) 
The owner of the property on which the specialized emergency response occurs;
(2) 
Any person involved in any activity which caused or contributed to the causation of the emergency;
(3) 
In cases involving the rescue or recovery of an individual, the individual and his/her employer if the person was in the Village in furtherance of the employer's interest; and
(4) 
In cases involving the rescue or recovery of property, the owner of the property and anyone who had custody or control of the property at the time of the emergency.
B. 
Charges. The charges for an emergency response of technical/specialized rescue services for the purpose of extrication, tactical rescue, high angle rescue, confined space rescue, below grade rescue, and/or trench rescue or any other nonwater rescue.
(1) 
Nonresident and technical/specialized rescue.
(a) 
Technical/specialized rescue services.
[1] 
Basic charge for team response: $1,000.
[2] 
Additional charges:
[a] 
One hundred twenty-five dollars per hour per vehicle;
[b] 
Thirty-five dollars per hour per team member; and
[c] 
Cost of all materials or equipment used in providing the response.
(2) 
The charges for an emergency response of technical/specialized rescue services for underwater rescue/recovery or any other water rescue.
(a) 
Water rescue/recovery.
[1] 
Basic charge for team response: $1,000.
[2] 
Additional charges:
[a] 
One hundred twenty-five dollars per hour per vehicle;
[b] 
Thirty-five dollars per hour per team member; and
[c] 
Cost of all materials or equipment used in providing the response.
(3) 
The charges for an emergency response by the Village of Flossmoor Fire Department for a motor vehicle extrication or fire for a nonresident.
(a) 
Nonresident motor vehicle:
[1] 
One hundred twenty-five dollars per hour per vehicle;
[2] 
Thirty-five dollars per team member or firefighter responding to a call for assistance; and
[3] 
Cost of extraordinary expenses for materials and equipment used in providing the response to the call for assistance.
C. 
Listing Village as rescue service for permit purposes. In addition to charges for Technical/Specialized Rescue Services response, if a person or entity within the Village requests that, pursuant to occupational safety and health laws, the Village or any intergovernmental agency to which the Village belongs be listed as the rescue service or as the backup rescue service on the permit of a permit-required confined space activity, the charge for such service shall be $1,000 per day. If a person or entity lists the Village as the rescue service or the backup rescue service without notifying the Village, in writing, in advance of entry into any permit-required confined space, the person or entity shall be charged $1,500 per day for each day the permit is outstanding.
D. 
Penalties for failure to pay charges. Any person or entity that refuses to pay or fails to pay the above-listed charges within 60 days of notice of the charge will be deemed to have violated this section and will incur a fine of not less than $100 or more than $750 for each offense, plus all legal fees and all costs incurred in enforcement. Such fees and costs shall include, but not be limited to, attorneys' fees and the cost of collection. A separate offense shall be deemed committed for each day on which a violation occurs and continues.
E. 
Additional specialized services (see § 33-2-5). In the event that it is deemed by the Fire Chief of the Village of Flossmoor Fire Department or his designee that it is necessary in the mitigation or resolution of a technical/specialized rescue event for the Village of Flossmoor Fire Department to call in MABAS 24, CART, or a separate, independent, specialized service or cleanup contractor, the responsible party shall be responsible for payment to the MABAS 24, CART, or separate, independent, specialized service or cleanup contractor all reasonable charges assessed by said contractor to complete the mitigation or resolution of the event. The responsibility for this payment shall be in addition to any and all applicable charges assessed against the responsible party pursuant to this chapter.
