No privy vault, septic tank or other receptacle for human excrement
shall be constructed in this municipality without a permit for that
purpose being first obtained from the Board of Health, upon such terms
and conditions as such Board may direct.
No privy vault, septic tank or other receptacle for human excrement
shall be built or maintained within 15 feet of any building or within
10 feet of any line or adjacent lot. Whenever these conditions for
any reason cannot be complied with, said septic tanks and vaults shall
be cemented and made and kept watertight. No privy vault or septic
tank shall be constructed, used or maintained at any place within
the limits of this municipality nearer than 50 feet to any well, stream
or source of water used for drinking or domestic purposes, nor shall
any privy vault be maintained unless it is so constructed that flies
or mosquitoes cannot gain access to the contents thereof, nor shall
the excremental matter be allowed to rise within one foot of the surface
of the surrounding ground or to overflow thereon.
No drainage from any closets, bathtubs, laundry tubs, kitchen
sinks or similar fixtures shall be permitted to flow upon the ground,
nor shall it be diverted into any surface or subsurface drain intended
to carry off the natural flow of surface or rain water or upon any
public or private highway. Such drainage must be conducted through
vitrified brick, concrete or iron pipe, not less than four inches
in diameter, to a properly constructed cesspool or sewer.
Proper provisions shall be made to guard against storm- or surface
water from washing the excremental matter out of any privy, cesspool
or receptacle.
Any person violating or refusing or neglecting to comply with
this chapter shall, upon conviction thereof by the local Municipal
Court, pay a penalty of not more than $500 nor less than $2 at the
discretion of the Court, and each day that such violation or refusal
or neglect to comply with this chapter shall continue shall be considered
a separate offense with a like penalty therefor.
