The Borough of Dormont hereby establishes a Commission to be
known as the "Shade Tree Commission," which Commission shall have
exclusive custody and control of the shade trees on the streets and
highways of the Borough, as well as trees in areas zoned as parks.
As used in this chapter, streets and highways shall be construed as
set forth in the Borough Code and shall include the entire rights-of-way of said streets
and highways within the Borough of Dormont. The Shade Tree Commission
shall exercise all the rights and perform the duties and obligations
imposed by this chapter upon the Shade Tree Commission and shall be
referred to as the "Commission" in this chapter. In the performance
of its duties as set forth in this chapter, the Commission shall not
employ any assistants. All work or assistance required by the Commission
shall be supplied or acquired by the Borough.
The Commission shall be composed of three residents of the Borough
who shall be appointed by the Council and shall serve without compensation.
The Council is hereby directed to appoint one member for a term of
three years, one for a term of four years and one for a term of five
years, and on the expiration of the term of any Commissioner, a successor
shall be appointed by the Council to serve for a term of five years.
Vacancies in the office of Commissioner shall be filled by the
Council for the unexpired term.
The Commission shall elect one of its members as the Chairperson
and one as the Secretary.
The Commission shall meet and organize on the first Monday of
each year.
Two members of the Commission shall constitute a quorum, and
no action of the Commission shall be valid unless it shall have the
concurrence of at least two members.
The Commission shall have the power to make and enforce regulations
for the care and protection of the shade trees of the Borough. No
such regulation shall be in force until it has been approved by the
Council and enacted as an ordinance.
The Commission shall annually report in full to the Council
its transactions and expenses for the last fiscal year of the Borough.
