A. The
Town Board is hereby authorized to compromise or settle any equitable
claim against the Town of Amenia upon such terms which, in the judgment
of the Town Board, are found to be just, reasonable and in the best
interest of the Town, including such claims that may not be legally
enforceable against the Town at the time of such approval of compromise
or settlement by the Town Board, except that this section shall not
be construed to authorize payment of equitable claims that are barred
by an applicable statute of limitations.
B. "Equitable
claim" is defined as a claim against the Town for damage for a nontortious
cause of action for which there is no judgment docketed and no litigation
pending.
