No person, firm or corporation, owning or occupying any property
within the Township shall permit any grass or weeds or any vegetation
whatsoever, to grow or remain upon such premises so as to exceed a
height of six inches, or to throw off any unpleasant or noxious odor,
or to conceal any filthy deposit, or to create or produce pollen.
Any grass, weeds or other vegetation growing upon any premises in
the Township in violation of any of the provisions of this section
is hereby declared to be a nuisance and detrimental to the health,
safety, cleanliness and comfort of the inhabitants of the Township.
Notwithstanding the above provisions, these provisions shall not apply
to those areas which are maintained, farmed, and used for agricultural
purposes and to those areas when the Township is conducting recycling
programs.

The owner of any premises, or the occupant of premises occupied by other than the owner, shall remove, trim or cut all grass, weeds or other vegetation growing or remaining upon such premises in violation of the provisions of §
10-101.

1. The Board of Supervisors, or any officer or employee of the Township designated thereby for this purpose, is hereby authorized to give notice, by personal service or by United States mail, to the owner or occupant, as the case may be, of any premises whereon grass, weeds or other vegetation is growing or remaining in violation of the provisions of §
10-101 of this Part, directing and requiring such occupant to remove, trim or cut such grass, weeds or vegetation so as to conform to the requirements of this Part, within seven days after issuance of such notice. Whenever, in the judgment of the [Enforcement Officer/Inspector] it shall appear to be impracticable to give notice as above provided, either because the owner or occupant cannot readily be found or because a search for the owner or occupant would entail unreasonable delay, the Board of Supervisors or any officer or employee of the Township designated thereby for that purpose, may give notice by posting conspicuously on the property where such nuisance exists, a notice or order directing and requiring that such nuisance be abated within seven days. In case any person, firm or corporation shall neglect, fail or refuse to comply with such notice within the period of time stated therein, the Board of Supervisors may order the removal, trimming or cutting of such grass, weeds or vegetation, or may remove, trim or cut such grass, weeds or vegetation and the cost thereof, together with a penalty of 10% of the cost thereof shall be collected by the Township from such person, firm or corporation, in the manner provided by law in assumpsit or equity.
2. For the purpose of the subsection, whenever an owner, occupant, firm
or corporation has been provided with a notice, such notice shall
be effective for 36 months from the date of the issuance or posting
of such notice, and it shall be the responsibility of the owner, occupant,
firm or corporation to continually maintain the property in conformance
with the provisions of this Part during that thirty-six-month period.

Any person who violates or permits a violation of this provision
of the Code of Ordinances of North Lebanon Township shall, upon conviction
thereof, be sentenced to pay a fine of not less than $100 nor more
than $1,000, and/or to be imprisoned for a period not to exceed 90
days. A separate offense shall arise for each day or portion thereof
in which a violation is found to exist.

Any individual, partnership or corporation of North Lebanon
Township may request escort service by the police of North Lebanon
Township.

Any request for escort service shall be made to the police department
of North Lebanon Township, and the request shall be 24 hours prior
to the time that the escort service is needed.

The police department of North Lebanon Township to accept or
reject the request for escort service. In the event that any emergency
arises at the time scheduled for the escort service, the police department
of North Lebanon Township shall have the right to assign the escort
service to another municipal police department, to reschedule the
time of the escort service or to cancel the escort service.

The party requesting the escort service shall furnish proof
to the North Lebanon Township Police that there is adequate insurance
coverage for any incident, loss or damage that might occur during
the course of the escort service. And the party requesting the escort
service shall execute a release of liability against the North Lebanon
Township Police and North Lebanon Township for any damage or loss
that might occur during the escort service.

Any party receiving escort service pursuant to this Part shall
pay the Township of North Lebanon according to the charges as duly
adopted by resolution of the Board of Supervisors of North Lebanon
Township. The party receiving the escort service shall be billed by
North Lebanon Township at the end of the month in which the service
is rendered, and payment shall be made on the bill to the Township
by the 10th of the month following the date of the bill.
