There shall be a Department of Health and Welfare, the head of which shall be the Director. The Department shall include the Office of Health, the Office of Local Assistance and the Municipal Youth Guidance Council.

A. 
Within the Department there shall be an Office of Health, the head of which shall be the Health Officer, who shall serve for a term of four years, coinciding with the term of office of the Mayor. Any qualified person within the Office of Health may be appointed pursuant to law to serve as the local Registrar of Vital Statistics, with or without additional compensation. The Office, within the limits of available appropriations, shall:
(1) 
Have all the functions, powers and duties of a local Board of Health, except that, as required by the Charter, the Council shall have and exercise all of the legislative powers of a local Board of Health.
(2) 
Plan and administer a comprehensive and public health program, including, but without limitation thereto, environmental sanitation, communicable disease control, child and adult health and health education, laboratory services and any other services as may be authorized by the Charter or ordinance and prescribed in Public Health Practice Standards of Performance for Local Boards of Health in New Jersey, promulgated by the Public Health Council of the New Jersey Department of Health.

(3) 
Administer and enforce local health ordinances pursuant to law.
(4) 
Maintain and administer records of vital statistics, including births, deaths and marriages, in accordance with state law, and issue marriage licenses pursuant to law.
(5) 
Supervise the collection and disposal of garbage and refuse in the Township, with reference to health hazards.
B. 
The Director of Health and Welfare shall be authorized to set, charge and have collected, on behalf of the Township of Washington, fees for recipients of certain health services offered through the Office of Health. Such fees shall be established as follows:
(1) 
The Director of Health and Welfare, after consultation with the Advisory Health Board, shall recommend a fee in writing to the Mayor of the Township of Washington.
(2) 
The Mayor shall have full power to accept, reject or modify said recommendation, after which time fees shall be charged and collected accordingly.
A. 
Within the Office of Health there shall be an Advisory Health Board, which shall be composed of no more than 10 members appointed by the Mayor. The members shall serve for staggered terms of four years from the date of their appointment, except that, at the time of their appointment, three shall be appointed for a term of one year, three for a term of two years, two for a term of three years and two for a term of four years. All members shall serve without compensation.
B. 
The Advisory Health Board, within the limitations of available appropriations, shall:
(1) 
Make recommendations to the Health Officer and Mayor concerning or relating to the operation and administration of the Office of Health.
(2) 
Make recommendations to the Council concerning or touching upon matters of policy or ordinance affecting the Office of Health.[1]

There shall be a Municipal Youth Guidance Council as may be authorized by resolution of the Council pursuant to law (N.J.S.A. 9:22-1 et seq.). For budget, personnel and purchasing purposes, the Municipal Youth Guidance Council shall come under the Department of Health and Welfare.
