The Board of Supervisors of North Lebanon Township does hereby adopt the International Property Maintenance Code — 2018, as amended, in accordance with the provisions of the code as are set forth on file in the office of North Lebanon Township, Lebanon County, Pennsylvania, at 725 Kimmerlings Road, North Lebanon Township, Lebanon County, Pennsylvania.

The owner of any real estate situate in North Lebanon Township shall not interfere with the flow of a stream, creek, or other waterway located on their real estate by means of dam construction or otherwise, including the failure to remove fallen trees or other debris located on the property.
This provision shall be enforced by the Township Code Enforcement Officer or such other party as is appointed and authorized by the Board of Supervisors of North Lebanon Township. Enforcement shall take place by the Code Enforcement Officer or such other authorized party sending the owner or owners a notice in writing of the violation and providing for a time period to correct a violation. Upon the failure of the property owner or owners to correct the violation within the time designated shall result in enforcement under the provisions of this Part.

In all cases involving the International Property Maintenance Code, any person directly affected by the decision of the Enforcement Officer may appeal the decision to the Board of Appeals under the procedures set forth in the International Property Maintenance Code. The Board of Appeals shall be established from time to time by Resolution of the Board of Supervisors of North Lebanon Township, and the appellant shall pay to North Lebanon Township such fees and costs as are determined by the Board of Supervisors of North Lebanon Township.

In the event that any of the provisions to the International Property Maintenance Code are in conflict with any other North Lebanon Township Ordinance, the North Lebanon Township Ordinance shall control.

If any section, subsection, sentence, clause or phrase of the International Property Maintenance Code is held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this Part.

All applicable fees and charges under the provisions of this Part and the International Property Maintenance Code shall be established by resolution of the Board of Supervisors of North Lebanon Township.
2. 
Condemnation. When a property or building has been condemned under this section by the Code Enforcement Officer or the Inspector, the property or building shall not again be occupied until the following conditions are met:
A. 
The Code Enforcement Officer issues a written notice that the property or building is no longer condemned.
B. 
The Code Enforcement Officer removes the condemnation signs from the property.
C. 
The access to the property or building is provided by the Code Enforcement Officer.
D. 
The responsible party has paid all of the inspections fees, legal fees, fines, penalties and costs that the Township has incurred in the matter, or the responsible party has made arrangements satisfactory to the Township for the payment of the inspection fees, legal fees, fines, penalties and costs incurred by the Township in the matter, together with the filing of a lien against the subject real estate in the amount due to the Township.

North Lebanon Township may enforce the provisions of the International Property Maintenance Code by filing an equity action in the Court of Common Pleas of Lebanon County, Pennsylvania, and in such proceedings, in addition to enforcing the provisions of the International Property Maintenance Code, the Court may enter such additional Orders as the Court deems appropriate, including entering an Order for attorney's fees, costs and penalty.

Any person who shall violate any provision of this Part shall, upon conviction thereof, be sentenced to pay a fine of not less than $200 and not more than $1,000 and, in default of payment thereof, to undergo imprisonment for a term not exceeding 30 days. Each day that the violation continues beyond the date fixed for compliance shall constitute a separate offense. In such proceedings, the person who is found to be in violation of this Part shall pay the attorney's fees and costs incurred by North Lebanon Township in the proceedings.
