Words and phrases shall be presumed to be used in the ordinary context unless such word or phrase is defined or interpreted differently. The following words and phrases shall have the particular meaning assigned by this section:
BOROUGH
The Borough of Huntingdon, Huntingdon County, Pennsylvania, a Pennsylvania municipal corporation acting by and through its Council or, in appropriate cases, acting by and through its authorized representatives.
FIRE COMPANY
Any person, partnership, corporation, nonprofit corporation, agency or department of a municipal corporation or other organization, or its members, the primary purpose of which is the preventing and extinguishing of fires and the protection of life and property.
HUNTINGDON FIRE DEPARTMENT
Huntingdon Fire Department, having its base of operations and principal station at 530 Washington Street, Huntingdon, Pennsylvania.
KNOX-BOX®
A small wall-mounted safe that holds building keys for HRFR,[1] medical services, and police to retrieve in emergency situations. The HRFR and other authorized emergency services (medical and police) can hold master keys to all boxes within Huntingdon Borough. The benefits of installing a key lock box provides immediate emergency access leading to increasing emergency personnel efficiency; preventing costly forced entry damage and allowing undamaged doors to be resecured after an emergency; protecting property, inventory, equipment/supplies, and reducing possible injury to the occupants or emergency personnel.

OWNER
Any person or entity which owns, leases, manages, and/or is in control of a structure, building, facility or property.

PERSON
An individual, partnership, corporation, or nonprofit corporation.
STRUCTURE
Any building, facility or man-made object.

No fire company or other person shall interfere or participate in any way in firefighting activities or respond to an alarm of fire within the confines of Huntingdon Borough unless such person or fire company is granted authority by the Borough to provide fire protection to the inhabitants of the Borough or is a fire company requested to assist a fire company granted such authority by the Borough or unless such person is a public officer.

The Borough authorizes and directs Huntingdon Fire Department to provide fire protection and to engage in firefighting activities within the geographical confines of the Borough.

The Borough may appropriate money to any fire company authorized to provide fire protection within the confines of the Borough for the purchase and maintenance of fire apparatus, for the operation and maintenance of the fire company and for the repair and maintenance of fire company stations.

Upon violation or threatened violation of the provisions of this subpart, the Borough may, in addition to other remedies, institute in the name of the Borough any appropriate action or proceeding to prevent, restrain, enjoin, correct or abate violations of the provisions of this subpart.

The Borough of Huntingdon hereby authorizes the Huntingdon Fire Department to collect from persons, corporations or any other entity who use their services a sum sufficient to reimburse said Fire Department in full for the time and effort spent by said respective fire company.

The Borough shall have the right, in the event that said payment is not made, to pursue these remedies in the Court of Common Pleas of Huntingdon County and to turn the successful completion of these processes over to the respective fire company which had rendered the services.

For purposes of this subpart, the charges for use of the Huntingdon Fire Department emergency services equipment, materials and personnel shall be established by resolution of the Council of the Borough of Huntingdon.

Any person, firm or corporation who shall violate any provision of this subpart, upon conviction thereof, shall be sentenced to a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of this subpart continues or each section of this subpart which shall be found to have been violated shall constitute a separate offense.

The placement of a key lock box is a regulated activity within the Borough of Huntingdon. In order to place a key lock box on any structure within Huntingdon Borough, the property owner must submit an application to obtain a permit. The established permit fee payable at the time of the submission of an application will be determined from time to time by resolution of Huntingdon Borough Council.

1. 
The following structures shall be equipped with a key lock box at or near the main entrance or other location identified by the Borough Code Enforcement Officer:
A. 
Commercial or industrial structures.
B. 
Multifamily residential structures (apartments, townhouses, row houses, or dormitories) with three or more living units that have restricted access through locked doors but have a common corridor for access to the living units.
C. 
Public schools.
D. 
Nursing care facilities.
E. 
Hospitals.
F. 
Commercial, industrial, and governmental structures and/or properties where access to or within a structure or area is restricted because of secured openings or where immediate access is necessary for lifesaving or firefighting purposes.
G. 
Additional structures deemed to be a high risk may be required to install a key lock box at the direction of the Borough.
2. 
All new construction subject to Subsection 1 of this section shall have a key lock box installed and operational prior to the issuance of an occupancy permit.
3. 
Any structure(s) converted into multifamily units as outlined in Subsection 1 of this section shall have a key lock box installed and operational.
4. 
All structures in existence prior to the enactment date of this subpart will be exempt until the structure is renovated, updated, modified, increase units, or any other improvements being made at which time all rules/regulations in accordance with the current Uniform Construction Code (UCC) will apply. The following structures (multifamily structure with 10 or more units, public schools, nursing care facilities, or hospitals) will not be exempt and must comply with this subpart as noted.
5. 
The following structures are exempt from the mandate to install a key lock box system:
A. 
Detached residential one-family and two-family dwellings and one-family townhouses.
B. 
Any structure or property having twenty-four-hour on-site personnel with accessible keys for the entire structure(s) or property may be exempt with written approval by the Borough.
C. 
Rental storage facilities where there is a single lock on the separate storage pods that are renter supplied; provided, however, the entry security gate(s) will require a key lock box if electronically controlled or locked with a master key issued by the landlord to all tenants.

The owner is responsible for ordering and installing the lock box.
2. 
The type of key lock box to be implemented within the Borough shall be an approved Knox-Box® brand system. There are different types of lock boxes available, which will permit access to the property/building for fire, medical, police, or on-site security personnel. The Huntingdon Regional Fire and Rescue is not optional and must be included in all lock boxes. Medical, police, or on-site security personnel are optional.
3. 
The owner of any structure or property required to have a rapid entry key lock box shall ensure that the Huntingdon Regional Fire and Rescue has complete unobstructed access to the lock box at all times.
4. 
All key lock boxes shall be installed at a location specified by the Borough Code Enforcement Officer with input from the Huntingdon Regional Fire and Rescue personnel.
5. 
All key lock boxes shall be flush mounted between 5 1/2 feet to 6 feet from the ground to the bottom of the box.
6. 
In the event that the rapid entry box system cannot be installed at the aforesaid location and/or height, the Borough Code Enforcement Officer will designate a different location and installation specifications.
7. 
All Knox-Boxes® shall have a tamper switch installed if the building has an instruction/burglar alarm.
8. 
All realty and/or property with locked gates, driveways, or electronic security gate(s) shall have the lock box installed outside of the gate, which will allow immediate emergency access to the property.
9. 
The Borough Code Enforcement Officer must approve any changes of the installation.

1. 
The owner of any structure or property required to have a rapid entry key lock box shall ensure that the keys contained within the lock box are up to date and provide access to all required areas within the structure or property. Whenever a lock is changed or new doors, gates, or panels are installed within a structure or property, the owner shall immediately notify the Borough Code Enforcement Officer to coordinate the placement of items within the lock box.
2. 
The owner of any structure or property required to have a rapid entry key lock box shall provide the Borough Code Enforcement Officer with up-to-date contact information that includes the owner's name; addresses; and facsimile, telephone, mobile phone, and pager numbers. Any change in this information must be provided in writing to the Borough of Huntingdon at least 48 hours in advance of the change occurring, along with the date such change will take place.

The contents of the lock box are as follows:
1. 
The lock box shall contain the key(s) for all exterior doors and gates, the keys for all interior doors and gates within the building, and the keys to all doors or panels which control access to shared systems, including but not limited to the following:
A. 
Mechanical rooms.
B. 
Electrical rooms.
C. 
Elevators and elevator control rooms.
D. 
Fire alarm panels.
E. 
Special reset pull stations or other fire-protection devices.
F. 
Any other keys as requested by the Borough of Huntingdon.
2. 
Each key shall be clearly labeled and easily identifiable.

No fire department, medical, police, or on-site security and/or other personnel shall carry a Knox-Box® key.
2. 
All Knox-Box® access keys shall be installed in a Knox-Box® SentraLoc system installed in an approved apparatus.

The Borough Manager shall be authorized to implement rules and regulations for the use of the key lock box system, which rules and regulations shall be posted by the Borough.
