There is hereby memorialized the position of Municipal Prosecutor in the City of Ventnor.
The term of the Municipal Prosecutor shall be for one year and shall continue until a successor is appointed.
The Municipal Prosecutor shall be an attorney at law in the State of New Jersey and in good standing. The Municipal Prosecutor must also meet any and all other qualifications and requirements applicable to Municipal Prosecutors in the County of Atlantic. The Municipal Prosecutor may, when he/she is unavailable for a Municipal Court session, have someone prosecute on his or her behalf as long as said person meets all of the requirements to be eligible as a Municipal Prosecutor.
The Municipal Prosecutor shall be compensated pursuant to the salary ordinance[1] adopted by the City of Ventnor or the contract entered into between the Municipal Prosecutor and the City of Ventnor.

The Municipal Prosecutor shall represent the state, the county or the municipality in the prosecution of all offenses within the statutory jurisdiction of the Municipal Court. This includes but is not limited to statutory violations and municipal ordinance/code violations pertaining to zoning, land or property use regulation, property maintenance, building or construction. A Municipal Prosecutor shall be responsible for handling all phases of the prosecution of an offense, including but not limited to discovery, pretrial and posttrial hearings, motions, dismissals, removals to Federal District Court and other collateral functions authorized to be performed by a Municipal Prosecutor by law or rule of court. For the purpose of this section, posttrial hearings shall not include de novo appeals in Superior Court.
