As used in this chapter, the following terms shall have the meanings indicated:
HELISTOP
An area of land utilized for the landing and takeoff of helicopters for noncommercial and emergency purposes. A helistop shall not provide for, nor include, fueling or maintenance of helicopters. Helicopters shall not be parked at the helistop except when loading and discharging passengers.
Helistops shall specifically exclude, and it shall be prohibited to conduct or allow, maintenance, fueling, storage of fuels or helicopter parking or storage. The helicopters shall only be permitted on the helistop for loading and discharging of passengers, not to exceed 15 minutes on the ground, except in cases of emergency. Emergency use can be so declared by the Mayor of Oceanport, the Chief of Police of Oceanport and the Deputy Chief of Police of Oceanport.
A. 
The helistop owner/operator shall be allowed to land and take off between sunrise and sunset only. The operation of the helistop shall start no sooner than May 1 and must cease on November 1 each year. Operation and landing of helicopters at the helistop before sunrise or after sunset and between November 1 and through May 1 shall be prohibited.
B. 
The number of flights in and out of the helistop shall be consistent with the temporary certificate of license issued for the helistop by the New Jersey Department of Transportation, Bureau of Aeronautics. The number applies to the helistop regardless of helicopter owner or operator.
C. 
The helistop owner/operator shall provide notice to the Borough Administrator of each takeoff and landing, at least 24 hours in advance if possible, but never less than four hours in advance of any takeoff or landing. The notice shall be provided by telephone communication and email so that a record of each takeoff and landing can be retained. Failure to notify the Borough Administrator of a planned takeoff or landing may result in a reduction in the number of takeoffs and landings that the Borough will allow.
D. 
Under no circumstances shall the helistop allow any more than 10 takeoffs and 10 landings between the valid dates of the license referenced hereinabove.
E. 
Under no circumstance shall refueling of the helicopter be permitted at the helistop.
F. 
The helistop owner/operator shall comply with all Federal Aviation Regulations (FARs).
Should the helistop owner/operator allow more takeoffs and landings to occur than are allowed within the temporary certificate of license, or more than the maximum allowed (10 takeoffs and 10 landings), the helistop owner/operator shall be responsible for a per-passenger fine for the offending takeoff or landing of not more than $2,000 for each passenger in the helicopter that exceeds the aforementioned takeoff and landing numbers.
