The Borough of Oceanport shall hereby permit memorial benches/picnic tables for friends and families to remember or honor individual(s) by sponsoring such benches/picnic tables.
As used in this chapter, the following terms shall have the meanings indicated:
BENCHES/PICNIC TABLES
A bench/picnic table as selected and approved at the sole discretion of the Borough Council, which shall include the bench/picnic table, a concrete pad, a memorial plaque, which plaque shall be affixed to such bench/picnic table and which plaque shall be inscribed with the name(s) of the person(s) selected by the applicant, and installation by the Department of Public Works.
The fee for each new memorial bench will be $1,500; for each new memorial picnic table $1,800; and $2,000 for an ADA memorial picnic table. The dedication shall be for an initial period of 10 years.
The order time for new benches/picnic tables is approximately six weeks from receipt of payment. Upon receipt of the bench/picnic table, the Department of Public Works may require a minimum of two weeks to arrange installation. Notwithstanding, depending on the time of the year, as well as the conditions of the desired location, installation may not occur for several months.
A. 
Applications shall be obtained from and, after completion, returned to the Borough Administrator. Upon approval of the application by the Borough Administrator and receipt of the correct fee, the application shall be forwarded to the Department of Public Works for plaque preparation and installation.
B. 
Memorial bench/picnic table locations shall be selected by the Borough Administrator.
C. 
Memorial benches/picnic tables shall be of a size, style and material as solely determined by the Borough of Oceanport. Plaques shall be of a size and style as approved by the Borough Administrator. Plaque inscriptions shall be approved at the sole discretion of the Borough Administrator.
D. 
Memorial benches/picnic tables shall be installed by the Borough of Oceanport at a location selected by the Borough Administrator giving due consideration to public safety. Benches/picnic tables shall remain in place year round unless otherwise determined by the Borough Administrator.
E. 
The Borough of Oceanport shall not be responsible for the replacement of benches/picnic tables or plaques that have been destroyed due to vandalism or natural occurrences such as fire or hurricane. Applicants may request the replacement of destroyed memorial benches/picnic tables and/or plaques at their own cost and expense. No replacement bench or plaque shall be installed without the express written approval of the Borough Administrator.
F. 
Should a bench/picnic table be damaged due to vandalism or natural occurrences such as fire or hurricane, the damage will be assessed by the Borough Administrator to determine if it is repairable. If the damage is $500 or less, the bench will be repaired with the additional monies that will be held in a trust from the initial fee. If a situation arises where the Borough Council feels that a memorial bench/picnic table no longer serves its purpose, is damaged beyond repair or is in a location where it hinders construction, approved community development, or public access, the Borough Council reserves the right to relocate or remove the memorial bench/picnic table.
G. 
Memorial benches/picnic tables shall remain the property of the Borough of Oceanport. Dedications shall be honored for a period of 10 years from the approval date. At the conclusion of this period, the memorial bench or plaque may be removed by the Borough unless, within 180 days from the date of expiration of the full dedication period, a renewal application and the requisite fee of $400 is paid to the Borough of Oceanport. All renewals shall conform to the rules and regulations as set forth herein for the dedication of an initial memorial bench/picnic table.
