A. 
The Borough Manager or his or her designee shall provide for the issuance of residential parking permits if it is determined by a parking study that any street or portion thereof of a particular zoning district, as defined and limited in Chapter 210, Zoning, is being used for parking by the operators of vehicles while the operators of those vehicles are using districts either within or beyond the boundaries of the Borough of Dormont for uses other than residential uses. The uses, other than residential, include but are not limited to commercial, industrial, recreational and institutional uses. This parking study shall be ordered by the Manager, on petition of at least 75% of the owners or tenants of residential dwelling units (one signature per dwelling unit) located on any numerical street block or any portion thereof for which parking permits are sought. A numerical street block shall be in increments of hundreds (i.e., 2800 Block). A portion of a street block eligible for residential parking permits shall be any section of a street (as defined in § 210-7 of the Dormont Borough Code) located within the Borough of Dormont and between any two crossing or tee intersections of such street, regardless of whether such intersections are located within or without the Borough. The parking study shall be conducted by the Borough of Dormont Police Department. If the study indicates that the average number of parking spaces utilized consistently during two observations, conducted within a one-week period, exceeds 50% of the total number of available spaces on such numerical street block, or portion thereof, the Borough Manager shall prohibit parking during the hours when such use has been found to occur on that numerical street block, or portion thereof, by the study. In such cases, the Borough Manager, upon the direction and approval of the Borough Council, shall cause appropriate signs establishing parking prohibitions except parking by permit holders who reside within that parking zone, the boundaries of which shall be established by the Borough Manager. Once permit parking has been adopted by the Borough pursuant to this section, it shall require a petition of at least 75% of the owners or tenants of residential dwelling units (one signature per dwelling unit) located on such numerical street block or portion thereof to remove the permit parking requirement. Once established, a period of two years must elapse before a petition can be presented to remove the permit parking requirement. Permits shall be granted upon payment of a fee and only under the following conditions:
(1) 
To persons who are residents of any particular street or portion thereof on which parking is so restricted, to be limited to the zone within which that particular street or portion thereof is located, for every vehicle owned by those persons and registered in the Commonwealth of Pennsylvania. No permit issued hereunder shall be valid for more than two years but may be renewed upon expiration, provided that the conditions for issuance exist.
(2) 
To residents on behalf of persons who are visitors of any residents of any particular street or portion thereof on which parking is so restricted, to be limited to the zone within which that particular street or portion thereof is located, to be valid for a period of two years, but may be renewed upon expiration.
(a) 
Visitor permits shall not be transferable. Residents who allow the visitor permit issued to their dwelling unit to be used by a person not a visitor to their dwelling unit shall, in addition to the penalties set forth in § 195-62 hereof, have said permit revoked for a period of one year beginning on the date of revocation. In addition, it shall be unlawful for a person to use a visitor permit who is not a visitor at the dwelling unit to which that permit is registered. It shall not be a defense that the permit was being used with the permission of the registered owner. Such person shall, upon being found liable therefor, pay a fine of not less than $50 nor more than $600, plus court costs and reasonable attorneys' fees incurred by the Borough in the enforcement proceedings. If the penalty is not paid, the Borough shall initiate a civil action for collection in accordance with the Pennsylvania Rules of Civil Procedure. Each day a violation exists shall constitute a separate offense. In addition to or in lieu of enforcement under this subsection, the Borough may enforce this subsection in equity in the Court of Common Pleas of Allegheny County.
(b) 
Should a visitor permit be lost or stolen, such fact shall be reported to the Police Department, which shall invalidate the same forthwith. Any person who possesses or uses a visitor permit which has been reported lost or stolen shall, upon being found liable therefor, pay a fine of not less than $50 nor more than $600, plus court costs and reasonable attorneys' fees incurred by the Borough in the enforcement proceedings. If the penalty is not paid, the Borough shall initiate a civil action for collection in accordance with the Pennsylvania Rules of Civil Procedure. Each day a violation exists shall constitute a separate offense. In addition to or in lieu of enforcement under this subsection, the Borough may enforce this subsection in equity in the Court of Common Pleas of Allegheny County. Lost or stolen visitor permits may be replaced upon payment of a fee as set by resolution of the Borough Council.
(3) 
To residents on behalf of persons who do business with any resident on any particular street or portion thereof on which parking is so restricted during the hours of such restriction, to be limited to the zone within which that particular street or portion thereof is located and within which any such person transacts business.
B. 
On the application of any resident of the particular street or portion thereof on which parking is restricted, the Chief of Police or his authorized designee may issue permits to be valid for only one day upon a showing by the resident that, during the hours for which the permits are to be issued, his residence will be used in such a way consistent with its residential character and other provisions of law and that persons doing business at his residence would not be able to park without violating the law. If the Chief of Police shall find the foregoing facts and further finds that the issuance of the permits will not unduly impair traffic safety during the time of their validity, he or she shall issue such permits and may limit the streets or portions of streets on which they shall be valid. The number of such permits shall not at any time exceed 50% of the number of spaces in which they are valid.
C. 
However, the parking prohibitions of this Part 2 shall not apply to service or delivery vehicles which are being used to provide service or make deliveries to dwellings.
D. 
The Borough Council shall determine a schedule of fees to defray the cost of issuing permits and other costs. The Borough Council shall be empowered to reevaluate the fee schedule and make necessary alterations to it. Such alterations shall not be considered an amendment to this Part 2 and may be adopted at any public meeting of Council by resolution.
Any applicant for a permit shall show to the Chief of Police or his or her authorized representative satisfactory evidence that he or she fulfills all of the conditions for such a permit. Whenever the conditions no longer exist, the person holding such a permit shall surrender it to the Chief of Police or his or her authorized representative. It shall be unlawful for any person to represent that he or she is entitled to such a permit when he or she is not so entitled, to fail to surrender a permit to which he or she is no longer entitled or to park a vehicle displaying such a permit at any time when the holder of such permit is not entitled to hold it.
A. 
Exempt vehicles.
(1) 
When performing the duties normally associated with the positions designated below, the vehicles operated by persons in the following professions shall be exempt from all provisions of this Part 2, Residential Permit Parking, of this chapter:
(a) 
Clergy.
(b) 
Home health care/visiting nurses.
(c) 
Mail delivery/United States Postal System.
(d) 
Funeral directors.
(2) 
Persons engaged in the above-specified activities must obtain a special placard from the Dormont Police Department which designates the exemption of the vehicle. This exemption is only applicable when the vehicle is being used in conjunction with the performance of such duties associated with the positions designated and when a placard or similar item indicating the nature of this activity is prominently displayed on the dashboard of the vehicle.
B. 
Annual permits.
(1) 
The following owners/operators of vehicles will be eligible for an annual permit (effective January 1 to December 31) at a fee as set by resolution of the Borough Council. This permit will authorize the owner/operator to park the vehicle designated by the permit in any of the residential zones when the vehicle is being used in conjunction with the performance of duties associated with property in that zone. Persons who are eligible for obtaining the annual permits are:
(a) 
Owners of rental property situated in a permit area with use restricted to those times that the property is being maintained and/or shown to future tenants. Properties must be registered with the Borough and have the proper occupancy permits on file in the Borough office.
(b) 
Persons who are property managers for rental property in a permit area with the same conditions and restrictions as in Subsection B(1) of this section.
(2) 
Permits must be obtained at the Dormont Police Department and must be assigned to a specific vehicle and are not transferable to any other vehicle. The permits will be a placard of a specific color and number, assigned to a host address (Borough building), and are renewable annually. The fee for such permit may be changed from time to time by a resolution of the Borough Council. Permit fees shall be paid in advance, and no pro rata refunds shall be made.
C. 
Temporary permits. Temporary permits must be obtained at the Dormont Police Department and will be issued for a period of two weeks. Increments of greater lengths of time may be purchased upon approval of the Police Chief or his designee. The temporary permits will be hanger-type permits which must be displayed on the rearview mirror of the vehicle. Only the resident and/or property owner in a permit parking area may apply for such permit on behalf of contractors who are performing work at the residence situated in a permit parking zone. All applicable building permits must be secured and approved by the Borough office prior to the issuance of a temporary parking permit. The fee for such permit shall be as set from time to time by resolution of the Borough Council for every two-week period. Permits shall be paid in advance, and no pro rata refunds shall be made.
The residential permit parking program shall be in effect Monday through Friday, from 9:00 a.m. until 6:00 p.m.
A. 
The signs placed on a restricted parking street under this Part 2 shall be of such character as to inform persons of the existence of the rules and regulations imposing the foregoing restrictions. It shall be unlawful for any person to violate such rules and regulations.
B. 
Any person violating any of the provisions of this Part 2 shall be subject to a fine of $10 and the costs of prosecution. Upon default in payment of such fine and costs, such person shall be committed to the county jail for a period of three days.
C. 
Parking meter attendants are hereby empowered to enforce the provisions of this Part 2.
Wherever metered parking is in effect in any portion of a district that becomes subject to the restrictions of this Part 2, the parking spaces controlled by meters may be excepted from the provisions of this Part 2 so long as the control by meters continues.
