As used in this article, the following terms shall have the
meanings indicated:
Any property within the Manifold Sewershed District No. 1
upon which there is erected a structure intended for continuous or
periodic habitation, occupancy or use by human beings or animals and
from which structure sanitary sewage shall be or may be discharged
into the sewer system.
That geographic area of the Township that includes the Windsor,
Quarry, Manifold and Racetrack sewersheds as depicted on Exhibit A
which is served or to be served by the sewer system.
All sewer lines and other facilities constructed, owned and/or
operated by WEWJA to collect, transmit and/or otherwise dispose of
sanitary sewage discharged by an improved property.
The Township of South Strabane, Washington County, Pennsylvania,
a political subdivision of the Commonwealth, acting by and through
its Board of Supervisors, or, in appropriate cases, acting by and
through WEWJA or other authorized representatives.
The Washington-East Washington Joint Authority, acting through
its governing board, as owner and operator of the WEWJA Treatment
Plant and, in appropriate cases, as agent of the Township hereunder.
The Township of South Strabane hereby establishes, adopts, and
creates the Manifold Sewershed District No. 1 for the purpose of providing
sewer collection service to the improved properties located within
the Manifold Sewershed District No. 1. The Manifold Sewershed District
No. 1 shall encompass that area of South Strabane Township as more
specifically identified in the sewer district area map attached hereto
and incorporated herein as Exhibit A.
A.
There is hereby fixed and imposed upon the owner of each property
within the Manifold Sewershed District No. 1 a special purpose tap-in
fee of $1,428 per equivalent dwelling unit (EDU) of capacity required
for connection.
B.
Each private dwelling unit or living unit (including each house,
townhouse, condominium, or apartment unit) shall have an EDU value
of one EDU per unit. The EDU value of any other uses shall be determined
by WEWJA.
C.
The special tap-in fee herein established shall be in addition to
any additional connection, customer facilities, or tap-in fees that
may be affixed and amended from time to time by the Township and WEWJA.
Connection to the sewer system located within the Manifold Sewershed District No. 1 shall be required as provided in Article III, Mandatory Connections, of this chapter.
No connection shall be made to the sewer system within the Manifold
Sewershed District No. 1 except in compliance with this chapter and
with the ordinances and resolutions, as well as such rules and regulations
which may, from time to time, be enacted, adopted, approved, or promulgated
by the Township and WEWJA.
The Township reserves the right to and may, from time to time,
adopt, revise, amend, and readopt such rules and regulations as it
deems necessary and proper for the connection of properties to the
sewer system located within the Manifold Sewershed District No. 1
and for the use, maintenance, and operation of the sewer system located
within the Manifold Sewershed District No. 1, and all such rules and
regulations shall be and become a part of this article.
In the event any provision, section, sentence, clause, or part
of this article shall be held to be invalid, such invalidity shall
not affect or impair any remaining provision, section, sentence, clause,
or part of this article, it being the intent of the Township that
such remainder shall be and shall remain in full force and effect.
