The caption of and recitals to this Ordinance No. 2018-01 as
set forth above are incorporated herein by reference.
The Township of Lancaster is authorized to enter into the agreement
in the form attached hereto as Exhibit A, for the purposes outlined above and contained therein.
This action is to be taken by the officials or employees of the Township
designated for this purpose, pursuant to general or specific instructions
issued by the Board of Supervisors.
As required by the Intergovernmental Cooperation Act, 53 Pa.C.S.A.
§ 2307, the following matters are specifically found and
determined:
A. The conditions of the agreement are as set forth in the agreement
identified above and attached hereto as Exhibit A.
B. The agreement shall become effective following enactment of an ordinance
authorizing entry onto the agreement by the parties and shall remain
in effect until terminated by mutual agreement.
C. The purpose and objectives of the agreement are to enter into a governmental
contract to provide for the maintenance, use and repair of Riverside
Avenue related to the development and use of the City Operations Center.
D. No expenditures are proposed by the agreement other than the costs
which the city shall expend relating to its development, construction
and use of the City Operations Center and the repair and maintenance
of Riverside Avenue. To the extent that the Township receives any
state liquid fuels monies to the portion of Riverside Avenue being
monitored by the city, the Township shall promptly remit the same
to the city.
E. The property to be developed is owned by the city and no additional
property, real or personal, shall be acquired, managed or disposed
of under the agreement, except for certain right-of-way along Walnut
Street extension which will be acquired by the city and used in connection
with the City Operations Center.
The Board of Supervisors reserves the right to modify, supplement
or amend the agreement from time to time by resolution or ordinance.
The provisions of this article are severable and if any section,
sentence, clause, part or provision hereof shall be held illegal,
invalid or unconstitutional by any court of competent jurisdiction,
such decision of the court shall not affect the remaining sections,
sentences, clauses, parts or provisions of this article. It is hereby
declared to be the intent of the Board of Supervisors that this article
would have been enacted if such illegal, invalid or unconstitutional
section, sentence, clause, part or provision had not been included
herein.
This article shall take effect and be in force after its enactment
by the Board of Supervisors of the Township of Lancaster and after
execution of the intergovernmental cooperation agreement by the Board
of Supervisors of the Township of Lancaster and the City Council of
the City of Lancaster, as provided by law.
