It is the intent of the Industrial (IN) Use
District to provide for the industrial development of the Town of
Lockport, including manufacturing, warehousing, wholesaling of manufactured
goods, communications, servicing, technology, transportation and other
industries, while protecting and enhancing the aesthetic ecology,
and livability of the Town of Lockport, and providing for the health
and welfare of its citizens. It is the further intent to expedite
approvals when necessary to encourage location of industry in the
Town.
No building, structure or lands within the Industrial
Use District shall be constructed, erected or used for other than
the following specified purposes:
A. Laboratories engaged in research, testing and experimental
work, including processes normal to laboratory practice and technique.
B. Trucking terminals, repair facilities, and the operation
of trucking and the common carrier businesses.
C. The manufacture, compounding, assembling and/or treatment
of articles or merchandise from previously prepared materials consisting
of fiber, glass, fur, leather, papers, plastics, wax, wood and wire,
provided that no chemical process is involved in the basic manufacture
of such materials.
D. The manufacture and/or assembly of mechanical devices,
electrical appliances, the machining and assembling of parts made
of metal, electrical and electromechanical devices and components,
not to include heavy stamp forgings and the like that would produce
vibrations, earth jarring or objectionable noise beyond the property
boundaries, and further provided that all necessary and approved safeguards
are employed to reduce hazard and annoyance to the community.
E. The manufacture and/or assembly of musical instruments,
novelties, toys or related products.
F. The manufacture compounding, processing and storage
of candy and confections, frozen foods, cosmetics, pharmaceutical
products, toiletries and food products, excluding abattoirs.
G. Wholesale business and storage of commodities.
H. Office buildings related to industrial business operations.
I. Other commercial, industrial or warehousing similar
to those specifically listed above.
J. Accessory uses related to any of the uses permitted
herein, such as equipment or product storage in tanker and trailing
operations, including limited retailing of above uses.
K. Electrical generation facilities, except for utility-scale solar
energy systems or commercial wind conversion systems.

The following uses may be permitted upon obtaining
a special use permit:
A. Uses causing some noise, dust, smoke or odor or similar
conditions, where the Planning Board (or the IDA Board, if it supersedes
the Planning Board's review) finds the benefit to the Town, its residents
or its economy justifies a lesser standard by specific evidence, including
job creation, and economic enhancement, provided such Board shall
also require mitigation of such conditions, and such uses shall be
permitted only upon a finding of necessity which outweighs aesthetic
and other considerations. Any such actions shall be Type I actions
pursuant to the New York State Environmental Quality Review Act and regulations.
B. Adult uses subject to the provisions of Article
XXIII of this chapter.
It is the purpose of this section to allow expedited
and single agency action on projects which enhance the economy and
employment of the Town of Lockport. Whenever an existing or proposed
industrial use in the Industrial Use District in the Town of Lockport
is located in the Town of Lockport Industrial Park established by
the Town of Lockport Industrial Development Agency (IDA), or is induced
by the Town of Lockport Industrial Development Agency in any part
of the Industrial District, the Industrial Development Agency (IDA)
Board may, upon written notice to the Planning Board, elect to assume
all site plan approval and special use permit powers for that use
for that project, whereupon the IDA shall undertake all such approvals,
in the place of the Planning Board, and shall have all authority otherwise
possessed by said boards for such use. The IDA shall then follow the
procedures set forth in this chapter and elsewhere for such review
and approval. The Board may elect to undertake all approvals and reviews
for a given project, or may specify certain reviews and approvals
it is undertaking.
