Editor's Note: Section 3 of this local law provided in part: The standards and requirements contained within this local law shall apply to all applications under the Town Code Chapter 138 Zoning, Chapter 104, Subdivision Regulations, and Chapter 113, Telecommunications Towers, and any other approvals of a discretionary nature required for land use development in the Town, including, but not limited to, site plan, special use permit and subdivision approvals, and all undertakings for land use and development in the Town of Ballston, except: i) such applications that were granted a variance from application of Local Law No. 5-2020, entitled "A Local Law Establishing a Moratorium on Certain Development in the Town of Ballston," by the Town Board; and (ii) such applications now under active review by the Town of Ballston Planning Board. An application is now under active review by the Town of Ballston Planning Board only when an application was submitted and accepted by the Town of Ballston Planning Board prior to July 17, 2020, and which was not denied a variance from application of Local Law No. 5-2020 by the Town Board. There are three applications now under active review and not subject to this local law. For each of those applications the zoning law in effect prior to this local law shall apply in all respects. The three now active applications relate to the following parcels of real property in the Town of Ballston: Tax Map Number: 248.-2-31, and address 97 Midline Road; Tax Map Number: 228.-3-27.1, and address 1262-1268 Saratoga Road; Tax Map Number: 216.-2-19, and address 994 Route 67. This local law shall be applicable to all applications and undertakings for land use, development and subdivisions within the Town of Ballston except those applications explicitly set forth herein. Should any of the applications explicitly set forth herein substantially change or become significantly modified, as determined by the Town of Ballston Planning Board, in consultation with the Town designated engineer, then in that event this local law shall in all respects apply to such changed or modified applications.
