There shall be four classes of licenses for the sale of alcoholic beverages
within the Borough, namely, plenary retail consumption licenses, plenary retail
distribution licenses, limited retail distribution licenses and club licenses.
The holders of the classes of licenses authorized by §
72-1 shall be entitled to the privileges and shall be subject to the limitations and responsibilities, as set forth in Title 33 of the Revised Statutes of New Jersey, and the rules and regulations promulgated thereunder by the Division of Alcoholic Beverage Control of the state and the provisions of this article.
The hours of sale for holders of plenary retail consumption licenses
and club licenses on New Year's Day are extended to 5:00 a.m.; provided, however,
that no holders of such licenses shall sell, serve, deliver or allow, permit
or suffer the sale, service or delivery of any alcoholic beverage or allow,
permit or suffer the consumption of any alcoholic beverage upon or from the
licensed premises between the hours of 5:00 a.m. and 6:00 a.m. on New Year's
Day when it falls on a weekday nor between the hours of 5:00 a.m. and 12:00
noon on New Year's Day when it falls on a Sunday.
During the hours when the sale, service, delivery and consumption of
alcoholic beverages are prohibited, all licensed premises shall be closed;
provided, however, that this closing of premises requirement shall not apply
to clubs or to other establishments where the principal business is other
than the sale of alcoholic beverages.
