As used in this article, the following terms
shall have the meanings indicated:
CONSTRUCTION/DEMOLITION DEBRIS
Components resulting from the construction and/or demolition
of a building or structure, both residential and commercial, including
but not limited to brick, cement, asphalt roofing, scrap metals, window
glass, wood, tree stumps, logs, branches and driveway and other like
materials.

Prior to the issuance of a permit for the demolition of any structure pursuant to N.J.A.C. 5:23-2.17 or other applicable regulation and/or the building of a structure, the person, firm or entity making such application shall post with the Construction Official security in the form of cash or certified check in the amount of 5% of the cost of the work. The purpose of the security shall be to ensure that all work shall have been performed in a good and workmanlike manner as well as to guarantee compliance with §
170-37 of this article, in addition to all other regulations.

Within five days after completion of demolition
and/or construction of any building or structure, the applicant shall
cause to be filed with the Recycling Official of the Borough a municipal
recycling tonnage application commercial business form and accompanying
documentation. Such form shall be available from the Construction
Official and shall be filed with the Recycling Coordinator of the
Borough. All debris must go to one of the approved New Jersey recycling
centers for Class B recycling materials.

In the event that within 30 days after construction of the building or structure the Recycling Coordinator has not received the required documentation pursuant to §
170-37 of this article and the Construction Official has been notified, in writing, of the commencement of litigation and the court in which such litigation has commenced and that said litigation alleges a violation of the purpose or condition of the security posted herewith, the Construction Official shall forthwith transmit such security to the Clerk of the court involved for disposition of the matter.

The provisions of this article may be enforced
by the Recycling Coordinator, the Health Inspector or the Building
Department.

Any person, firm or corporation who violates
or neglects to comply with any provision of this article or any rules
or regulations promulgated pursuant thereto shall be punishable by
a fine not to exceed $1,000. Each and every day that a violation continues
shall be considered a separate offense.
