For the purposes of this article, the following
words and phrases shall have the meanings respectively ascribed to
them by this section:
BITUMINOUS
A hard surface pavement as set forth in the Standard.
DEVELOPER
Any person who engages, either through himself or by an agent
or contractor, in a land subdivision or the construction of one or
more buildings within the Borough or undertaking any project involving
the construction or improvement of any street.
DRAINAGE
The runoff, natural or otherwise, of any surface or underground
water, including but not limited to rainfall.
OCCUPANT
The owner, tenant, lessee or person in charge of or in control
of or in possession of any building or premises or part thereof or
of any personal property within the Borough.
OWNER
The person having the legal title to lands and premises or
to personal property situated within the Borough.
ROADWAY
That portion of the street provided for vehicular traffic.
SIDEWALK
The pavement or walking space lying between the roadway and
the street line.
STANDARD
The Standard Form of Specifications for Municipal Construction,
as now or hereafter on file in the offices of the Borough Clerk and
Borough Engineer. All improvements shall conform thereto, and all
provisions thereof shall be binding upon all persons unless specifically
provided in this article to the contrary.
STREET
Any public thoroughfare, street, avenue, road, boulevard,
park, lane, terrace, concourse or passageway 15 feet or more in width,
whether or not dedicated or deeded to public use and whether or not
surfaced or paved.
WRITTEN NOTICE
Written notice shall be considered to have been served if
delivered in person to the individual or parties intended or to any
agent, foreman or superintendent of a corporation or if sent by registered
or certified mail to his or its last known address.
The Planning Board may, after a proper investigation
and hearing, recommend to the Mayor and Council that certain requirements
of this article be waived where it appears to be in the best interest
of the Borough that such waiver should be granted. The Mayor and Council
shall, thereafter, either approve or disapprove such recommendation.
The Mayor and Council shall also have the power to waive such requirements
on its own motion.
Any real estate development involving the improvement, clearing or regrading of one or more lots shall come within the provisions of this article and of Chapter
275 and shall conform to the rules and regulations of the
Planning Board.
