The purpose of this article is to establish a methodology for calculating sewer and water connection fees based upon the guidelines set forth in N.J.S.A. 40A:26A-11 ("Connection fees"), N.J.S.A. 40:26A-11.1 ("Additional connection or tapping fee for material increase in level of use and greater demand on sewerage system; amount"), N.J.S.A. 40A:26A-11.2 ("Connection or tapping fee credit; conditions; calculations; exclusions"), N.J.S.A. 40A:26A-11.3 ("Reduction in connection or tapping fee for new connections to sewerage system for public housing authorities, non-profit organizations, or other affordable housing units; connection or tapping fee credit; amount"), and N.J.S.A. 40A:26A-12 ("Rates, rentals, connection fees, or other charges as lien on real property; discontinuance of service").

As used in this article, the following terms shall have the following meanings unless the context clearly indicates that a different meaning is intended.
SEWER CONNECTION FEE
The fee required from a new connector to the sewer utility, representing a fair payment toward the total capital cost paid for developing the sewer utility system.
SEWER CONNECTION RATE
The total capital cost, including debt service, paid by the sewer utility to develop the sewer utility system through the end of the preceding fiscal year, divided by the total number of EDUs and service units served by the sewer utility at the end of the preceding fiscal year.
SEWER SERVICE UNIT
In attributing service units to each connector, the estimated average daily flow of sewage for the new connector shall be divided by 240 gallons, which represents the average daily flow of sewage from the average single-family residence within the City, to produce the number of service units to be attributed.
WATER CONNECTION FEE
The fee required from a new connector to the water utility, representing a fair payment toward the total capital cost paid for developing the water utility system.
WATER CONNECTION RATE
The total capital cost, including debt service, paid by the water utility to develop the water utility system through the end of the preceding fiscal year, divided by the total number of EDUs and service units served by the water utility at the end of the preceding fiscal year.
WATER SERVICE UNIT
In attributing service units to each connector, the estimated average daily flow of water for the new connector shall be divided by 300 gallons, which represents the average daily flow of water for the average single-family residence within the City, to produce the number of service units to be attributed.

A. 
A connection fee shall be imposed for each sewer connection, based on the sewer connection rate set forth herein and the total number of equivalent dwelling units attributed to a connector set forth in the schedule, or the total number of service units attributed to a connector when the schedule does not apply.
B. 
A connection fee shall be imposed for each water connection based on the water connection rate set forth herein and the total number of equivalent dwelling units attributed to a connector set forth in the schedule, or the total number of service units attributed to a connector when the schedule does not apply.
C. 
The connection fees imposed by this section are hereby waived for the following construction: for public buildings and public improvements constructed for or constructed by the municipality within its boundaries.

The connection fee imposed shall be payable at the time of the issuance of a construction permit.

When a business, structure or use is described in the Schedule of Equivalent Units, the connection fee shall be computed by multiplying the number of EDUs attributed to the connector by the sewer connection rate or the water connection rate set forth herein.

When a business, structure or use is not described in the Schedule of Equivalent Units, the connection fee shall be computed by multiplying the number of service units attributed to each connector by the sewer connection rate or water connection rate set forth herein.
In the event a business, structure, or use, is not described in the Schedule of Equivalent Dwelling Units, the owner or developer shall provide to the City Engineer a certification from an engineer, for the average daily projected sewer flow and water consumption for each business, structure or use. The water connection fee and the sewer connection fee shall be calculated based on the certification provided in accordance with the above formulas.
Where a building or structure is to be occupied by more than one residential, commercial or industrial use or establishment, or any combination thereof, the connection fee imposed shall be determined by applying the aforesaid schedule or formula for each residential, commercial or industrial use or establishment located thereon.

The sewer connection rate for each equivalent dwelling unit (EDU) and each service unit is hereby established at $1,740. The water connection rate for each equivalent dwelling unit (EDU) and each service unit is hereby established at $940.

The connection fee shall be adjusted when the estimated average daily flow is known and imposed at the time that the occupancy permit is issued.
Industrial or manufacturing building
a.
The sewer connection fee shall be based on the estimated average daily flow of sewage.
b.
The water connection fee shall be based on the estimated average daily flow of water.
c.
If a certification from an engineer cannot be provided estimating the average daily sewer flow or water flow at the time that the construction permit is issued, then the connection fee imposed shall be based on the following: each 2,400 square feet or portion thereof.

d.
The connection fee shall be adjusted when the estimated average daily flow is known and imposed at the time that the occupancy permit is issued.
Warehouse
a.
The sewer connection fee shall be based on the estimated average daily flow of sewage.
b.
The water connection fee shall be based on the estimated average daily flow of water.
c.
If a certification from an engineer cannot be provided estimating the average daily sewer flow or water flow at the time that the construction permit is issued, then the connection fee imposed shall be based on the following: each 10,000 square feet or portion thereof.

d.
The connection fee shall be adjusted when the estimated average daily flow is known and imposed at the time that the occupancy permit is issued.
