It shall be unlawful for any persons to remain
idle or loiter in front of or in the neighborhood of any store, shop,
restaurant, luncheonette or in any other place of business, without
limitation, or in or on the public streets, sidewalks, highways, roads,
alleys or any other public grounds, parks, places or buildings, without
limitation. No person shall be found guilty of so remaining idle if
he establishes that he had a legitimate business or purpose in so
doing.
It shall be unlawful for the parent, guardian or other adult person having the care of custody of any minor under the age of 18 to knowingly permit such minor to remain idle or loiter in violation of §
123-1.
Whenever any minor under the age of 18 is arrested for violating §
123-1, the Chief of Police shall notify the parent, guardian or other person having custody of such minor of such arrest.
If it be established that any minor under the age of 18 remained idle or loitered in violation of §
123-1 between the hours of 9:00 p.m. and 6:00 a.m. of the following day, then it shall be presumed, in the absence of proof to the contrary, that the parent, guardian or other adult person having the care or custody of such minor knowingly permitted such minor to do so.

Anything to the contrary in this chapter notwithstanding,
it is hereby established that no person shall, between 1/2 hour after
sunset and 1/2 hour before sunrise, loiter or remain in any park or
recreational area or playground within the jurisdictional boundaries
of the Township of Saddle Brook and within the jurisdiction of the
Township Council of the Township of Saddle Brook, except in an emergency
and after notifying a police officer and then only after permission
has been received or granted by said police officer to be in said
park for a specified period of time.
If it be established that the parent, guardian or other adult person having the care or custody of any minor under the age of 18 was duly notified pursuant to §
123-3 that such minor had been arrested for a violation of §
123-1, and it be further established that such minor subsequently remained idle or loitered in violation of §
123-1, then it shall be presumed, in the absence of proof to the contrary, that such parent, guardian or adult person knowingly permitted such subsequent violation.
Any person or persons violating any of the provisions
of this chapter shall, upon conviction thereof, be punished by a fine
not exceeding $200 or by imprisonment in the county jail for a term
not exceeding 90 days, or by both such fine and imprisonment.
